Information for parents outlining the following…

1) Current legislation for home based childcares
2) The role of regulatory bodies

As your child’s childminder I would like to inform you of some very important information detailing up to date legislation and information on the relevant regulating bodies for home based child carers.
This is to ensure your child get the very best possible care when in my setting.

1. CURRENT LEGISLATION RELEVANT FOR CHILDMINDERS

The Children act of 2004

Arose from the green paper “Every Child Matters” and identifies five outcomes for all children. 1. Be healthy 2. Stay safe 3. Enjoy and achieve 4. Make a positive contribution 5. Achieve economic well-being

Childcare act 2006

This introduced the Early years Foundation Stage (EYFS) into England

Race Relations Act (1976)
Amended in 2000
Equality of opportunity must be promoted and settings should develop a policy that is monitored and assessed,

Sex Discrimination Act (1975)

Supported by the equal opportunities commission to ensure that individuals are not discriminated against on the grounds of their sex.

Reporting Of Injuries Diseases, and Dangerous Occurrences Regulations (RIDDOR) (1995)
Specify certain accidents and incidents that must be by law reported.

2. THE ROLES OF THE REGULATORY BODY “OFSTED”

In the UK the regulatory body is OFSTED, Ofsted have processes and systems to control home based childcare in the following ways.

Registration

This covers checks on the childminder and other adults who live with the childminder and the premises where they plan to carry out their work.

Inspection

This is when inspectors carry out checks on the service the childminders offer and on the childminder themselves once registered. They produce a report, which is then available on websites of the regulatory bodies and must be offered to parents.

Investigation

Following a complaint or concern an inspector may carry out an investigation into the childcare service to make sure that all welfare requirements are being met. This is in addition to an inspection.

Enforcement

If welfare requirements and standards are not being met the regulatory body can take action against the childminder.
