Answer TWO questions. You can choose any two questions from the six available. All questions carry equal marks. Answer all questions on a separate page of the answer book.

Students are permitted to take One A4 Lever-Arch file into the exam, containing any material they wish to use.

EXAMINATION PAPER FOR CONTRACT LAW
1. Milo owns an art gallery and he telephoned four of his best customers, Olivia,
Richard, Steven and Teresa, who he thought might be interested in a new picture that he had. He left messages on their respective answer machines on
Monday to say that he had one picture:
“Circa 1902 Frank Bott oil painting: Loch Lomond from above Ballach, available to the first person paying £450”. He also said that it could be viewed at the gallery. Olivia received the message and telephoned Milo and offered him £350. He refused. Later on Monday she posted a letter to Milo agreeing to pay the £450.
The letter got lost in the post.
Richard was worried that the painting would be sold and he emailed Milo on
Tuesday agreeing to pay £405 (the price less the usual 10% discount he gets).
Milo did not access the email until Wednesday afternoon.
Steven picked up the message on Tuesday evening and he immediately telephoned Milo’s gallery and left a message on the answering machine stating that he would pay £450. Milo accidentally deleted all of his messages without listening to them.
Teresa decided to attend the gallery on Wednesday morning. She got there just as Milo was opening the shop and they agreed she could buy it for £450.

    There is no contract between Ada and Ben. This is because initially Ben leaves a message on Ada’s voicemail to accept the offer.     The issue is whether Apparat Pty Ltd can take legal action against Dali. In this case, Apparat as a retailer who sells expensive imported sports car has engaged Dali an advertisement agency to advertise his product on a TV station. The agreement agreed to be last for two years. It is said that Apparat wants to cancelled that week’s advertisement slots after knowing that the TV station was planning to run a movie based around the search for the wealthy driver who carelessly knocks down children, killed them and callously drives off which is scheduled to be run on Sunday night. However, Dali neglects to do so. In the agreement, it is stated that Apparat would have the right at any time up to 4 days prior to the broadcasting date to cancel any particular booking. Hence, Apparat should phoned Dali to cancel that week’s slot before Tuesday since the movie was planned to run on Sunday night. The word used in the case given as ‘planning to run a movie’ shows that the TV station have not yet to confirmed whether to broadcast the movie on Sunday night or not. However, since Dali neglects to called off the advertisement on that week, Apparat has experienced losses with the declining sales plus with his reputation as a retailer has been damaged.
