(title or description) What affect this has or would have on my classroom practice
Note: Tutor will be teaching a wide range of the theory and practical elements relating to Business Start-ups and Permaculture, so this will have to take place in a variety of environments - classrooms, industrial workshops, and outdoor countryside locations.
Legislation
Data Protection Act 1998
The tutor needs to be very careful as to what information they record about an individual, and only ask for personal data that is relevant to the service being delivered (the training).
Be it on paper or electronic any personal information being held must be kept securely and confidentially – don’t leave document folders out on desk etc keep locked away when not in use, and only give info out to those as specified in the DPA registration.
The organisations DPA registration will state the scope of use and disclosure for the type of info being held - so it must not be used for any other purposes no matter how well intended.
The tutor as an individual and/or as the representative of the organisation is responsible for ensuring the information held is accurate and up to date – so never guess or assume, only record personal details as given by the individual or from a verified source.
The DPA defines personal data as "data which relate to a living individual who can be identified (a) from those data, or (b) from those data and other information which is in the possession of, or is likely to come into the possession of, the data controller, and includes any expression of opinion about the ". So Tutors need to be careful about comments.
But what is not obvious is that in recent rulings electronic image (photographs) of people in some circumstances can also be classed as personal data. So class or course activity photos need to be considered and individual approval sought before using on social media, websites, and promotional materials
