Against Statutory Rape
For many years statutory rape has been a main issue across the whole United States. There are many different and types of statutory rapes depending on what state it was committed in and exact details of the encounter. Now we do not believe in all types of statutory rape being right because there are all different kinds of them as we have said before. some of them are where innocent minors have been tortured and harmed purposely and we grieve and pray for them, but the ones who allowed it are the ones who we are talking about and are against. They should not be allowed under any circumstances to press charges against the person who did it to them. What we exactly want is to charge and modify the laws of statutory rape by saying that have common

The case of Mathew Koso indicates that he was jailed for between 18 and 30 months because of having premarital sexual affair with a minor. The accused sparked a relationship with the girl when she was only 12 years and married her when she was 14. At that time, the marriage was legal, but the attorney general of the state of Nebraska found the affair illegal, sentencing Koso to the specified jail term. This decision is plausible for two reasons.…

When the law regarding sexual assault was written, these types of crimes did not carry the penalties and time limitations that they do now. I venture to say, it was not viewed as serious as it is now, and the knowledge we have gained on the psychological damage and trauma these types of offenses cause was not known. Even today, victims of sexual abuse are stigmatized and they often find it hard to come forward to report the crime because they feel that they are a fault somehow, or are viewed as “damaged goods” and may have to recount the crime in a public forum thus bringing embarrassment and humiliation upon themselves and their families. I believe California’s law was in good faith to correct an error and address the problems associated with these types of crimes. However, the majority did not see it that way.…

DeVos’ plan to revoke this letter produces two separate sides that are either for or against whether or not it would be beneficial to rescind the guidance presented in this letter from 2011. As I did my research into this particular issue, it became apparent to me that most media, news articles, and forums were strictly against Secretary DeVos’ plan to remove the guidelines in place. It seems that there were two main reasons people were against her plan. According to civil rights attorney Alexandra Brodsky, most are against Devos’ intention to rescind the guidance because they strongly believe that although the laws do not change, removing this helpful language would, however, make the guidelines of reporting and acting against sexual assault…

This essay aims to outline the development of the definition of rape in Scots Law. First we will briefly look at how Roman Law regards rape, then proceed to consider the opinions of the institutional writings of Hume, Burnett and Alison. Following on from this we will explore how case law in the 19th and 20th century further developed defining rape. Continuing we will consider why the definition of rape required to be reviewed, leading to reforming the offence from common law to statutory legislation and finally drawing together concluding remarks.…

The main reason is the law recognizes eighteen-year-olds as adults. If the law were to go by maturity, instead of a set age, there will be complications. On account of the law, statutory rape would be a difficult situation to address. Statutory rape is for someone sexually assaulted under the age of 18. If there was no set age on becoming an adult, what would be classified as statutory rape? Statutory rape would not exist for someone under the age of eighteen. For example, Caiti is 14 and her boyfriend is 19. If Caiti is raped by her boyfriend, she can file for statutory rape. You can file for statutory rape even if you wanted to have sex. If statutory rape was not used to convicting rapists, then rape victims would be more terrified to make an accusation. Do you really want your child or loved one to lose the right to file this against someone? Most criminals are charged with this crime. If statutory rape did not exist, these criminals would be spending less time in jail. In 2000, there was one statutory rape for every three forcible rapes. Three out of five victims of statutory rape are aged 14 to 15. Three out of ten statutory rape incidents are boyfriend, girlfriends. Six out of ten incidents were acquaintances (ncjrs.gov). Do you really want your son or daughter to be sexually assaulted and the criminal to get away with it? If eighteen-year-olds are not recognized as adults we would not have this law to keep children and adolescents…

The contention that rape should be regarded as an asexual act has done nothing to remedy this. Nor will it. As activist and writer Wendy McElroy points out, "there can be as many motives for rape as there are for murder and other violent crimes … Rape is every bit as complex." Insisting that no rape is ever "about" sex but is rather about an individual man acting on a patriarchal mandate to sow terror by exercising "power" does a disservice to us all. (qtd. in Baker)…

The Bosnian genocide is often referred to as the hidden genocide, yet it had catastrophic effects on humanity. Over 100,000 people were killed and it displaced millions of people. The genocide occurred between 1992 and 1995. The Social Federal Republic of Yugoslavia was made up of six nations under the leadership of Josip Broz Tito. Once Tito passed away in 1990, there was a power vacuum, and politicians began a nationalistic campaign pitting Serbs, Croats and Bosniaks against each other. Hence, the beginning of an “ethnic cleansing” war (Campbell, 2003 p.511).…

It is shown all over the world and sometimes we don’t even realize it. It is not at all uncommon to hear things like “that test just raped me” on campus. Because of my past experiences, I do not use phrase like that, but I cant say I speak up when they are used. It is difficult to speak up when someone uses the word out of context because it is so common to hear, and I know the people saying these phrases do not actually mean to offend anyone. I believe the reason rape gets thrown around like it is nothing is because society has made this image of it not being that big of a deal. For example, the video talks about how 3 of 100 rapists will ever go to prison; it is this kind of leniency that makes rape culture increase. In most cases, victim blaming occurs. The video explains victim blaming as the act of blaming the victim by what they are wearing or how much they drank. After covering this topic and reading the chapter, I believe a huge part of my best friends story had to do with victim blaming. She was so criticized for putting herself in that situation that the rape occurring did not seem to matter, as if the boy had the right to do so just because she was out number and hanging with older boys. It sickens me that society has allowed rape culture to even become a topic, and it has come this far. The occurrence of rape taking place on college campus is scary, and the statistics…

Rape leads into my next argument, abuse. When a mother conceives a baby she is not ready for, or simply does not want, abuse is sometimes a “way out” for her. A parent may physically, mentally and emotionally abuse their child. A child never deserves to be beaten but being abused is better than never existing at all. A young being has the chance to grow in and out of their abusive life in later years. Every abused child should suck it up and suffer the pain until reaching years of freedom.…

The recent Globe and Mail investigation regarding sexual assault cases has caught the attention of many individuals. The article “Why police dismiss 1 in 5 sexual assault claims as baseless,” states that the study involved over 870 police forces in Canada. The article states that 19.39 per cent of the sexual assault complaints that were received over a four-year period of time, were dismissed by police forces as being unfounded (Doolittle, 2017). The article also states that according to research from North America, the United Kingdom and Australia, between 2 per cent and 8 per cent of complaints were considered false reports (Doolittle, 2017). Nonetheless, I agree that for serious complaints like sexual assault, the police should have no…

One of the solutions to this problem is the Prison Rape Elimination Act of 2003. Although it is called the Prison Rape Elimination Act it includes all state and privately owned facilities including; federal, state, and local prisons, jails, police- lock- ups, and community settings like residential facilities. The act, voted on unanimously by the House of Representative and Senate, was the first national step toward a new understanding of the problem of sexual abuse in correctional and detention facilities. This act outlines specific details of what constitutes as a sexual abuse, “(a) the carnal knowledge, oral sodomy, sexual assault with an object, or sexual fondling of a person, forcibly or against that person's will; (b) the carnal knowledge, oral sodomy, sexual assault with an object, or sexual fondling of a person not forcibly or against the person's will, where the victim is incapable of giving consent because of his or her youth or his or her temporary or permanent mental or physical incapacity; or (c) the…

And while rape is still very much a pervasive issue, I would much prefer laws regarding effective consent to an arbitrary age restriction which curbs children's sexual freedom and feeds into harmful views of children as property, as monolithic, as things uniformly incapable of making their own decisions who suddenly become enlightened once they cross an arbitrarily-defined…
