Age Discrimination Employment Act Case Study
The Age Discrimination Employment Act (ADEA), which is applicable to organizations who employ twenty or more employees, prohibits age discrimination against older employees. Under the “disparate impact” theory of liability, employers can be liable for discriminatory compensations regardless of their good intentions, which would be the case for The City of Tampa Florida Police and Fire Fighter Departments. A disparate impact claim arises when an employer’s policies and practices, seemingly neutral and non-discriminatory, result in harsher treatment for one group of protected employees than another. The scary part for employers is that liability under a disparate impact theory is determined by focusing on the effects of an employer’s actions
