PETITION

COMES NOW the petitioner, by counsel, unto this Honorable Court, most respectfully avers that:

PARTIES

1. Petitioner, Cristita C. Quirino (Cris for brevity) is of legal age, Filipino and presently residing at Brgy, Sambag, Cebu City, Cebu, married to respondent. For the notices and processes of this Honorable Court, petitioner may be served thereof at the undersigned counsel’s address;
2. Respondent, James L. Yee (James for brevity) is likewise of legal age, married to the petitioner, and is last known by Petitioner to be residing at ACM Subdivision, Quijada St., Mambaling, Cebu City, Cebu 6000, where he may be served by notices, orders and processes of the Honorable Court.

FACTS OF THE CASE

3. That on April 10, 2003, petitioner and respondent were lawfully married at MTC-Br, III, Cebu City, solemnized by Judge Esperidion C. Riveral, which matrimony was further blessed by Rev. Father Anselmo Nicasio on October 10, 2003 in religious rites at the Sto. Rosario Parish Church, Cebu City, as shown and evidenced by their marriage contracts, xerox copy of which are herewith attached and made integral part hereof.
4. They have only one child named Baby James Q. Yee, born December 25, 2003 as shown on the Birth Certificate, xerox copy is herewith attached and made integral part hereof ; 5. They are governed by absolute community of property having no stipulation to the contrary;

6. That after said marriage, petitioner and respondent lived together as husband and wife, and it was during this period when petitioner slowly came to noticed several manifestations and discover that respondent was
