Art 2 Sec 25 of the Philippine Constitution
FOURTEENTH CONGRESS OF THE REPUBLIC) OF THE PHILIPPINES First Regular Session SENATE S. B.No. - 332 Introduced by Senator Miriam Defensor Santiago

EXPLANATORY NOTE The Constitution, Article 11, Section 25, provides: The State shall ensure the autonomy of local governments.

A local government unit is a political subdivision of the State, which is constituted by law and possessed of substantial control over its own affairs. Remaining to an intra sovereign subdivision of one sovereign nation, but not intended, however, to be an “imperium in imperio,” the local government unit is autonomous in the sense that it is given more powers, authority, responsibilities and resources (Alvarez vs. Guingona,Jr., 252 SCRA 695 [1996]). Unfortunately, the free exercise of such autonomy is hampered with the imposition, in the absence of full consideration by Congress, of unfounded mandates on local government units. These unfounded mandates displace other essential local government priorities, impose contradictory and inconsistent requirements, and compound the fiscal difficulties of local government units to render basic services to the people. Hence, this bill seelcs to curb the practice of imposing unfounded mandates on local government units in order to allow them to efficiently manage local affairs.*

* This bill was originally filed during the Thirteenth Congress, First Regular Session.

Each country has many political bodies that help her function systematically. Amongst this complex web in which each string strengthens and facilitates a nation to function lays the local government. A local government also referred to as a municipality not only provides its residents of a nation with various services and programs for the convenience and well-being of its residents, such as fire protection, animal control, traffic control, water supply and public transit to name a few. They also provide a gateway for the local community to express and address its collective objectives and work towards achieving them. It is a municipality that provides citizens with an opportunity to select its representatives who in return make decisions that echo their views and take action in accordance to them. As C Richard explains: “ The municipality is an extension of the community, the community governing itself, displaying a municipality and society work together to make a peaceful and superior society.…

The local level of government consists of systems that operate independent of one another in every city across the country. The state level of government is similar to the federal level. Each state has its own system of government that operates under the umbrella of the federal government. State governments consist of three branches just as the federal government does. State governments are responsible for things such as state lawmaking, collecting state taxes building and maintaining state highways and funding state parks and preserves. The federal government has more power and authority than state or local governments, although each level has the power to check each other. The federal government has an entire system of federal employees responsible for running the day-to-day operations(Bowman & Kearney, 2014, Chapter 2).…

In addition to general-purpose local governments, there may be local or regional special-purpose local governments, such as school districts and districts for fire protection, sanitary sewer service, public transportation, public libraries, or water resource management.
