QUESTION 1
a) Explain four (4) sources of written law which are used in Malaysia.
i) The Federal Constitutions
- The supreme law of the country.
- Apart from laying down powers of the Federal and States Governments, it also enshrines the basic or fundamental rights of the individuals.
- These rights written into the Constitutions can only be changed by a two-thirds majority of the total number or members of the legislature.
ii) State Constitutions
- Each state possesses its own constitution regulating the government of the States. - There are constitutions of the 13 States comprising the Federation, which form part of the written law in Malaysia. - The State Constitution contains provisions which are enumerated in the Eight Schedule to the Federal Constitution.
iii) Legislation Refers to law enacted by a body constituted for this purpose that is the Parliament at the Federal level and State Legislative Assemblies for the state level.
Examples, Acts of Parliament, Ordinances, Enactments.
The Parliament and the State Legislatures are not supreme. They have to enact laws subject to the provisions set out in the Federal and State Constitutions.
iv) Subsidiary Legislation
- Made by persons or bodies under powers conferred on them by the Acts of Parliament or State Assemblies, example rules and regulations, by laws, guidelines.
