According to the California BPC 4300 (a), it is possible to suspend or revoke license that was issued, when the license holder acts in an unprofessional manner. BPC 4301. These unprofessional behaviors include any kinds of actions that cause harm to oneself or to the public, such as self-administering controlled substances, dangerous drugs or alcohols. BPC 4301 (h). Additional unprofessional conduct that could result in suspension of license includes violating the federal and state pharmacy laws and regulations. BPC 4301 (o). Section 4060 of the California Business and Professional Code states that controlled substances should never be possessed by any individual except when a person has a valid prescription from a physician. Iacobo since the pharmacist’s unprofessional conduct was a threat to the public safety. This case is more severe than simply self-administering a controlled substance because an accident was involved, which could have even caused death of others. Also, the pharmacist knowingly and willfully violated the laws and regulation of controlled substances. Therefore, this case would potentially result suspension of his pharmacy license for certain period of time. To mitigate the discipline, pharmacist will argue that his self-administration of controlled substances was not the reason for his car accident, and should not be considered in determining his discipline. He will argue that car accident can happen anytime, and unless it can be proven that his car accident was definitely caused by the drugs, he shouldn’t be punished based on it. He will argue that he should be only punished by his self-administration of controlled substance, and given probation of 5 years. From this case, I have learned that I should always keep in mind to act professionally and never violate the laws and regulation of pharmacy. I should also remember the six ethical principles of pharmacy that I have learned from this class, and always act in an ethical manner in my pharmacy
