Madoff: Greed over Ethics?
Bernard Lawrence Madoff is a former American stockbroker, investment advisor and financier that surprised the world of finance when it was uncovered that he had been operating the largest Ponzi scheme in history for near two decades. The fraud worth approximately 65 billion dollars ruined the lives of many who had trusted Madoff with their money and admired him as successful, charismatic, smart and exceptionally good at his job. Some even considered him as a hero, including his employees and his sons who strived to please him.
Bernie was born in 1938 in Queens, New York. He attended University of Alabama which he left a year later and transferred to Hofstra University where he graduated in 1960. Madoff later founded his firm, Bernard L. Investment Securities LCC and became self-employed. The firm became one of the largest market makers. However, what he did was to deposit all clients’ funds into a single bank account and used it to pay clients that wanted to cash out. He kept up this scam by attracting new investors using his charisma, reputation and persuasive skills. Bernie could have kept this charade going longer not only because he had the good reputation but mainly because he had people’s trust. They believed in him and paid for it. When the market sharply downwards in 2008, investors were panicking and began cashing out their money, Madoff was unable to keep up the fraud. He confessed to his sons that a branch of his firm was actually a Ponzi scheme. They reported him to the authorities and he was arrested the next day. He pled guilty to 11 felony charges and on June 29, 2009, he was sentenced to a 150 year in

    Madoff’s scheme to defraud his clients at Bernard Lawrence Madoff Investment Securities began as early as 1980 and lasted until its exposure in 2008. Bernard carried out this scheme by soliciting billions of dollars under false pretenses, failing to invest investors’ funds as promised, and misappropriating and converting investors’ funds to benefit Madoff, himself, and others without the knowledge or authority of the investors. To execute the scheme, Madoff solicited and caused others to solicit potential clients to open trading accounts with Bernard Lawrence Madoff Investment Securities (BLMIS) on the basis of a promise from him. He promised to use investor funds to purchase shares of common stock, options and other securities of large, well-known corporations, and representations that he would accomplish high rates of return for client, with limited risk. (“United states of,” 2009) Among other things, Mandoff marketed to clients and prospective clients an investment strategy referred to as a "split strike conversion" strategy. Clients were promised that Bernard Lawrence Madoff Investment Securities (BLMIS) would invest their funds in a basket of approximately 35-50 common stocks within the Standard & Poor's 100 Index (the "S&P l00"), a collection of the 100 largest publicly traded companies in terms of their market capitalization. Mandoff claimed that he would select a basket of stocks that would closely mimic the price movements of the S&P 100. Mandoff further claimed that he would opportunistically time those purchases, and would be "out of the market intermittently, investing clients' funds in these periods in United States Government issued securities such as United States Treasury bills.     Bernie Madoff was a thief, plain and simple. He was a greedy, selfish, self-indulgent con artist, no different from any other grifter that you meet, except because of who he was, he was able to pull the con off on a grander scale. Madoff used his name and position and the legitimacy of his first business to draw people into his Ponzi scheme (like a pyramid scheme where one takes money from newer clients to pay older clients). He misrepresented (the kinder word) or lied (if you want the truthful description) to his friends and clients from the beginning and as later documented in his allocution, he never invested any of the money he got. It would have been different if this scheme formed from some bad business decisions and he did this in response to that and was trying to save some of his client’s money, but it wasn’t. Madoff originally provided his clients the 10-12% returns on investment that he offered, but it appears that with the increase in funds, the persons that benefitted the most from the Ponzi scheme was Madoff and his family. They all shared in an expensive and lavish lifestyle bordering on the garish with its excesses. He appeared to hire incompetent people so no one would be the wiser to what he was doing which was a disservice to his clientele. He also appeared to have used some of his misbegotten gains and infused them into his legitimate business therefore, putting it at risk.
