A shared ownership occupier is someone who owns a specific percentage of their home and this is usually a joint ownership with the person who built the property. This tends to be arranged with the local council or a social landlord, who may of paid to build the property and is now selling off a ‘stake’ in the property. Like a full owner occupier the costs of a shared ownership property will usually be met by either mortgage for the percentage ownership of the property over a set number of years or by paying the cost of purchasing said percentage of the house in full.…

RULE OF LAW: Under Arkansas law, a deed to two or more persons presumptively creates a tenancy in common unless the deed expressly creates a joint tenancy. They cite Ark.Code Ann. § 18-12-603 (1987), which reads as follows: “Every interest in real…

Looking at Martin’s case legally, he was right to contact the attorney for the necessary legal actions. According to laws that states joint ownership of properties, a co-owner of a joint tenancy with rights of survivorship deed may sever the joint tenancy by filing a petition to partition. This was the same case that the son of Peter, Andrew did. They had a right to terminate the joint ownership with him because he was unable to clear a loan. When a joint co-owner deals in any way with a property inconsistent with a joint tenancy, that co-owner will be treated as having terminated the joint tenancy. (“The Benefits And Pitfalls Of Joint Tenancy,” n.d.) In my own opinion in that case of lenders trying to foreclose the property, they shouldn’t have done that to the whole property but rather with the interest or shares that were initially owned by the Peter and let the others co-owners to continue enjoying their properties.…

Looking at the first issue from a legal perspective, the problem involves a joint tenancy with right of survivorship. According to Segal (1998), “Pursuant to this right, upon death of one of the joint tenants, the interest held by the tenant passes to the remaining joint tenants without having to undergo probate”. However; there is another underlining issue with this property. Opie, Andy son, apparently took a loan out against the interest of his share of the property and defaulted. The bank is trying to foreclose on the property.…

As opposed to U.S. partnership law, which holds property brought into or acquired by the partnership becomes property of the partnership; in Quebec, you can bring the property into a partnership and have it considered separate from other partnership property (Kubasek, M., Herron, Dhooge, & Barkacs, 2013). Under the Civil Code of Quebec (CCQ), in the area of contributing property to the partnership; made by the transfer of the owner’s rights, the contribution of the property establishes a distinct separate level of partnership property within the partnership (Boodman, 2010). When a partner brings in property to a partnership; the property, is separate from other partnership property as opposed to the property becoming co-owned among the members of the partnership. In the case of a bankruptcy, while the partners are still liable for the debts of the partnership; the partnership cannot liquidate property brought into the partnership by a partner to pay the debts of a partnership. Additionally, the creditors of a partner will not be able leverage the property brought into a partnership in the case of a charging order, unless that the property was brought into the partnership by the partner who sold them their partnership interest.…

Joint tenancy is different from both tenancy in common and a tenancy by the entirety. Joint tenancy is different from tenancy in common because joint tenancy is the ownership of real or personal property by two or more persons with the right of survivorship; whereas, tenancy in common is the ownership of an undivided interest of real or personal property by two or more persons without the right of survivorship. In a tenancy in common, each person has the right to hold or occupy the whole property in common with the other co-tenants, and each is entitled to share in the profits derived from the property. Unlike a joint tenancy, when a tenancy in common dies, the decedent’s interest goes to an heir or as directed in a will. Joint tenancy is unlike tenancy by the entirety.…

The first issue to resolve is whether the Owners Corporation has a duty to fix The Waves’ pool heater. In the Strata Schemes Management Act, common property is defined as any land in a strata scheme that is not composed of a lot. On the presumption that the pool is common property, it is vested in the Owner’s Corporation as agent for the lot owners as tenants in common proportional to the unit entitlement of their lots.…

Joint tenancy is a form of ownership of the same property by two or more people together. It is different than other forms of co-ownership. With joint tenancy, the last surviving tenant immediately becomes the owner of the whole property upon death of the other joint tenant. Another way of putting this would be called a "right to survivorship." The joint tenants share equal ownership of the property and have equal, undivided right to keep or dispose of the property. The right to survivorship also means that the joint tenant cannot give his/her interest of a property by will or intestate descent.…
