On May 24, 1992, Ramon Flores was working at a gas station that was getting robbed and was shot and killed. The man charged with his murder was Michael R. Pulido. He was charged with first degree murder along the felony murder law. That law states that killing during the act of a felony, in this case a robbery, is automatically first degree murder. The way I have interpreted the facts of this case, the defendant was the one who pulled the trigger and point toward him as the killer. To come to this decision, the jury had to conclude that the defendant had intent to commit a felony, killed during the act of a dangerous felony, and that the victims death was a foreseeable outcome of the felony.…
Candidate Spencer took the time to develop a plan and write his order prior to briefing. SNC briefed an extremely detailed five paragraph order, including an exhaustive Execution paragraph, and accurate information from higher’s warning order and fragmentary order. However, SNC spent 80% of his time prepping and briefing his order, showing an inability to effectively manage his time. Once SNC began executing the mission, he did not compensate for the time spent on his order, and his sense of urgency was lacking. SNC had a low frequency of verbal and non-verbal communication with his team and thus had some difficulty maintaining awareness and control of his team member’s movements. Upon consolidation, SNC controlled his security well, assigning…
Candidate Miller struggled to deliver a five paragraph order that was in accordance with the OSMEAC format. Although SNC was able to brief some of the information he received from the instructor, he only mentioned "mission" and "signal" before briefing the sub-paragraphs. Additionally, SNC delivered the order with choppy, mumbled phrases and utilized excessive filler words. Candidate Miller displayed minimal confidence, and although he briefed a scheme of maneuver prior to execution, it was clear that he was making it up as he briefed. The tasks he gave to his fire team also lacked clarity and gave the impression they had not been thought through. During the execution, SNC used phrases that displayed lack of assertiveness such as "we should…
SNC conducted a five paragraph order that was incomplete. SNC addressed all paragraphs of the five paragraph order with the exception of the Command and Signal paragraph. A subordinate prompted SNC to brief the Command and Signal portion of the order. SNC also did not task any of his fire team to get the magnetic azimuth. Despite having an incomplete five paragraph order, SNC did brief the order with confidence, using an aggressive voice which demonstrated a clear understanding of the mission. SNC developed an initial plan prior to starting the execution. SNC struggled with inter-team communications during the execution of the mission, which caused the fire team to step off in the wrong direction. The fire team got lost and had to be instructed…
This is to move the court to reopen and terminate my immigration proceeding and remand the case to USCIS to continue with the adjustment of my I485 application based on the followings:…
Candidate Olsen's brief was thorough, confident, and clear. SNC spent an elongated time briefing his order. This took away from the time allotted to execute the mission. Prior to the execution phase, SNC posted security oriented in the wrong direction. SNC did not look at the obstacle prior to his initial plan. As a result, his initial plan lacked key elements required to complete the mission. Although, SNC did not anticipate points of friction he was able to recognize the need for a decision during points of friction. SNC was noticeably hesitant when making decisions. As a result, his fire team members stood around, not progressing towards mission accomplishment, and waiting for guidance and direction. The decisions SNC made during…

This case is talking about an executive retreat. It was introduced by John Matthews who was a executive had been selected to attend the two-and-a-half-week retreat. The retreat was more like a competition about academic and athletic. The team members should not only get know each other and cooperate with teammates but also need to compete with others. The whole participants were broken into five groups and their aim was to win the competition. There are several sessions about academic and athletic that the participants should complete. After the introduction part the case showed the experience of John. Before the group meeting John was wondering and worried about this retreat. When he was taking the first group meeting, he tried to learn the backgrounds of other team members. And the he paid more attention to learn about his team leader. Besides introducing the team leader the case also showed the retreat’s theme was Think-Communicate-Cooperate. It meaned people who attend this retreat should think less about themselves and try to communicate and assistant to others. And then John showed his recollections of the members in his group individually. There are twelve members in his group. Everyone in his group had different characteristics. After group meeting they set up four basic goals about this retreat. In the second part of this case was a chart of first day’s seating arrangement and their performance of the first few days. Even though the first days’ results were not very good, the whole group still worked on their original goals. In the last part of the case was another chart that showed the last few days seating arrangement and the group performance about this whole retreat. Their goals made before the retreat almost all defeated. Even though John thought he improved, the whole group failed. Question 1…

SNC confidently addressed all paragraphs of the order in a logical and confident manner. SNC’s initial plan lacked specific tasking and direction. SNC had initial difficulty issuing orders and direction. SNC used phrases which included “Let’s get two candidates” to complete a task and “do you want to give it a try.” SNC used available resources and became more confident in leading as SNC’s subordinates responded to tasking and began to gain momentum. SNC overcame friction points. As SNC made initial success, SNC became more directive and assertive in leading after the first candidate overcame the obstacle and secured the ammo can. SNC was…
Candidate Murillo used a lot of time preparing his order; SNC used almost a full minute after he received the order from the evaluator, which displayed a lack of urgency. During order delivery, SNC used filler words several times, and had to pause on occasion to check the information before briefing it to his team. However, SNC did brief all of the paragraphs in the order, including the subparagraphs provided by the evaluator, including a Mission paragraph with purpose statement. SNC included formations in his scheme of maneuver and billet assignments in the Execution paragraph. During movement, Candidate Murillo had to be redirected to the objective by the evaluator, but was able to remember the mission once the aggressor made noise in…
Candidate Summerour provided a five paragraph order that contained most of the needed information to carry out the mission, but not much more and not necessarily in the proper order. SNC’s brief was very choppy and SNC seemed overwhelmed with the amount of information he needed to organize and disseminate. His scheme of maneuver was hasty and was briefed after the tasks. The tasks assigned did not have a purpose. SNC’s execution went well until the one point of friction, the simulated casualty, occurred. SNC did not give orders to neutralize the enemy for a few moments. During this time his sense of security was lacking. He left the casualty where he fell and took the rest of the fireteam to assault the enemy, having no assistance or cover…
Facts. On the morning of August 31, 1986, Theresa Estrada left her home near Cerritos, California, to go shopping at a nearby grocery store. She left her husband at home reading the newspaper, and her three children were still in bed. Returning from the store, Estrada saw, heard, and felt a big explosion. Within minutes, she maneuvered her way through burning homes, cars, and debris to find her home engulfed in flames. Her husband and children died in the house. Although she did not know it at the time, an Aeromexico passenger airplane had crashed into her home after colliding with a privately owned plane. Estrada suffered severe emotional distress from the incident. She sued for the wrongful death of her family. Aeromexico was found not responsible for the accident. The jury found the private pilot 50 percent liable, and the United States 50 percent liable because air traffic controllers had failed to detect the private plane's intrusion into commercial airspace and give a traffic advisory to the Aeromexico flight. The jury awarded Estrada $5.5 million for the death of her family and $1 million for negligent infliction of emotional distress. The U.S. government appealed the $500,000 judgment against it for negligent infliction of emotional distress.…
