History: Federal Trade Commission instituted a deceptive advertising proceeding against Kraft Inc. Kraft was instructed to terminate certain ads due to false advertising.
Facts: In March 1987, Kraft added a subscript on the television commercial and as a footnote in the print media version, the disclosure that “one ¾ ounces slice has 70% of the calcium of five ounces of milk.” FTC has claimed that Kraft Inc was representing false advertisement. Kraft Inc had used two television advertisements that claimed that their cheese had 5 ounces of milk per slice, which is what kids bones needs to grow.

The Kraft website has more users friendly you can go on there and click on the different products and on some of the products they offer coupons and pretty detail description of the product. There is so much on the Kraft website that it can be over whelming because there are so many options on the page. Hansen’s website is nice and pleasant to the eye it feels more homely. It makes you feel like you are not looking at a huge company website. Kraft has so many products that there are a lot of generic products out their trying to replicate Kraft’s product. Also with Kraft’s known overseas they have to deal with the competition their also because there are so many food companies out there. Kraft is able to keep up with their competition by doing more research that will appeal to their customers. For instance the latest thing is recycling so Kraft has developed new ways to package their products and using recycled products and making sure when they make this packaging they do not have any waste. These appeals to a lot of people because of the think green motto. Kraft also keeps coming up with new products so can stay ahead of their competitors. Hansen’s products are more originally with the organic sodas and energy drinks so there are not too many generic products that compare to their product. Mental retardation is a condition diagnosed before age 18 that includes below-average general intellectual function, and a lack of the skills necessary for daily living. We should not sentence a mental retarded to death because there was a delay deficiency in all aspects of development. How can you punish a person if they do not have all the skill as a person without any deficiency? It is unfair to even to think about the death sentence for action he did not know he was committing. People with mental retardation can fall prey when people with greater intelligence decide to take advantage of them, and they become the involuntary tools of others. As one expert in mental retardation has noted, "Most people with mental retardation don't act alone. They are usually dependent. They are never the ringleader or the leader of a gang.” People with mental retardation may also engage in criminal behavior because of their characteristically poor impulse control, difficulty with long-term thinking, and difficulty handling stressful and emotionally loaded situations. One example is when William Smith, I.Q. 65, tried to take money from "old Dan," a friendly elderly storekeeper he had known all his life. When Dan resisted, Smith panicked and lashed out, killing him. Low logical skills and limited planning capacities mean that people who have mental retardation are more likely than people of normal intelligence to get caught if they commit crimes.     Facts: Matt Theurer was an 18 year old adult that worked at McDonald’s part time. His friends and family worried about him because he had many extra-curricular activities, worked for the National Guard, and worked for McDonalds. McDonald’s informal policy did not allow high school students to work more than one midnight shift per week or split shifts. There was a special clean-up week McDonald’s held, Theurer worked five nights. One night he worked until midnight, another until 11:30pm, two nights until 9pm, and another until 11pm. On Monday, April 4th, 1988, Theurer worked from 3:30 until 7:30pm, followed by the clean up shift beginning at midnight until 5am on April 5th, and then he worked another shift from 5am until 8:21am. During that shift, Theurer told his manager he was tired and asked to leave from his next regular shift. The manager accepted his request, and Theurer began to drive home. He was driving 45 miles per hour on a two lane road when he either fell asleep or became drowsy. Theurer crossed the dividing lane into on-coming traffic, and crashed into Frederic Faverty’s minivan. Theurer was killed and Faverty was seriously injured. Faverty settled his claims with Theurer’s estate, and then he filed suit against McDonald’s.…
