Case Study On Hudson Avenue And Cordova Street
INTRODUCTION:

This case involves the suspect being arrested for driving under the influence of alcoholic beverages in violation of CVC 23152(a)(b)-DUI and CVC 23103(a)-Wreck less driving.
LOCATION DESCRIPTION:
This incident occurred on Hudson Avenue and Cordova Street.

INVESTIGATION:

On 02-29-17 at approximately 2119 hours, I responded to Hudson Avenue and Cordova Street to assist Corporal Ward #9222 on a traffic stop. Upon my arrival, I saw that Corporal Ward had contacted Suspect Giovanni Zapien, who was sitting in the driver’s seat of a grey Ford Mustang with paper plates.

Corporal Ward had Zapien step out of the vehicle regarding a wreck less driving investigation (Refer to Corporal Ward’s report for additional information). Corporal Ward directed Zapien to seat on the east curb line of Hudson Avenue as

I directed Zapien to stand on the east sidewalk of Hudson Avenue. I saw that Zapien was unsteady as he walked to the sidewalk. The concrete on the sidewalk slopes to the south and was lit by streetlights and my handheld flashlight. Zapien was facing north during the standard field sobriety test.

I observed that Zapien’s eyes were watery and bloodshot as I spoke to him. I believed Zapien may have been under the influence of an alcoholic beverage. I had Zapien follow the tip of my finger with his eyes to determine if he had horizontal gaze nystagmus. I saw that Zapien did have horizontal gaze nystagmus and lack of smooth pursuit.

I smelled a strong odor of an alcoholic beverage emitting from Zapien’s breath as he spoke. I asked Zapien if he had anything to drink. Zapien told me that he drank two beers (Modelo and an 805) at Del Frisco’s Grille located at 55 S. Lake Avenue in Pasadena. While at the restaurant, he began drinking the beers on 02-29-17 starting at 1700 hours. Zapien stated he stopped drinking the beers on 02-29-17 at approximately 1800
