Case Summary: The Case Of Seaworld Of Florida V. Perez
SeaWorld of Florida v. Perez was a case that shows how important is for a companies to have rules and regulations regardless Safety. The company must follow OSHA regulations to have a safety work place for the employees. In this case the court was trying to determine if SeaWorld of Florida violated the OSHA General Duty Clause and if the company have a process to reduce the danger that employees have when working with killer wheals. In 2010 Ms. Dawn Brancheau a SeaWorld trainer was performing with a killer wheal named Tilukum. The performance was going normal until the killer wheal grabbed the trainer from the platform into the pool, the animal refused to release her, the trainer died from traumatic injuries. Companies must provide a safe working environment to the employees at all times. SeaWorld of Florida argument to the court, that working with killer wheals is not recognized hazard because they are train and all wheals behave different. Another argument was SeaWorld provide proper training to his employees.
It also trains its employees who work with killer whales to recognize particular behaviors that it calls “precursors,” which indicate that the killer whales may act aggressively, and keeps detailed incident reports of when its killer whales had behaved aggressively or otherwise undesirably toward trainers, including pulling trainers into the pool. "They are under a constant low level of stress simply by being confined when they are built to travel long distances,” (Bubar). As a baby whales growing up, they tend to stick by their mothers and family. Orcas might look gentle, nice, and harmless, but when pushed, they are an entirely different wild animal.     That SeaWorld separates the families, and lies about the death of Dawn Brancheau (one victim of Tilikum), and that SeaWorld makes killer whales become psychotic and aggressive. SeaWorld claims that Blackfish is propaganda, not a documentary.     A video shown in the documentary Blackfish shows an incident that procured on November 3, 1987 of one of the experienced trainers getting crushed between two whales. Luckily this trainer survived along with another 70 others on documented reports from whales injuring humans throughout the years that SeaWorld has been operating. Yet, others have not been so fortunate, in the past years one whale in particular, Tilikum, has taken the lives of 3 people in the 30 plus years he has been held in captivity. One trainer who was very experienced and cultivated a boundless connection with Tilikum was Dawn Brancheau. Written in Tilikum's description explained in Blackfish it is said that he often lunges at trainers which is a serious problem when a 1200lb animal does this and should have been established as a threat against humans after the first two deaths. Sadly in 2010 Tilikum took Dawn's life in a brutal way by dismembering her and breaking the bones in her body before ultimately drowning her in the middle of her last performance. These types of deaths are preventable and SeaWorld should have taken care of this ordeal in the past before it occurred again, instead after the incident happened SeaWorld blamed Dawn for her own death. This is extremely unprofessional and unorthodox to blame someone who is dead and cannot even talk for themselves, SeaWorld should be tremendously ashamed of their accusation.
