Discrimination against women are very pervasive. Women have to face all the social, economic or even political problems. They are facing the problem from the womb itself as in early times there was one tradition which was prevailing in India where if a girl child is born to any family than they have to make her die. From that point of view till today’s world women are facing discrimination. Even this Child Marriage is also one of the major problem that mostly girl child has to face for having so many reasons behind it.

From many years till today girls are not given that much importance as compared to boys and girls are also seen as a burden on the family. No equal opportunities given in the education also and this problem happens because of transportation facilities as in rural areas schools are very far from the village and parents are having fear for their girl child because easy transport is not available and they do not sent their child to the school and start thinking for the marriage of the child.
Avoiding share in the ancestral property is also one of the reason for child marriage. If marriage of girl done at the early age than she is not going to ask for her rights in the ancestral property. For benefiting male heirs female heirs are denied property rights in practice, in spite of statutory provisions, by resorting to early child marriage.
Legal instruments have already declared child marriage as to be crime and which is unacceptable but if we see the reality than it is totally different. Child marriage is clearly violation of the rights of the girl child, everyone has right to live freely without any discrimination and live with human dignity. By marrying a child at the age when actually they need proper care and protection is like taking their rights from them away and at that age, child even does not know the proper laws which are available to them. For example India has passed Prevention of Children from Sexual Harassment act, 2012 which says that any sexual act with a child who is below the age of 18 is an offence and at the same time under the Prohibition of Child Marriage Act 2006 which says that child marriages are voidable and make them valid once they solemnized it. In which case child has to enter into a sexual relation and there is no bar from it. Even under the Indian Penal Code which has exception that sexual with the wife under the age of 15 is not a rape. All these principles are contradictory to each other. All such contradiction needs to be corrected and there is need to make certain uniform law regarding the prohibition of child
