Samenvatting
Sterling Drug vennootschap naar het recht van de staat New York is ook in Nederland houder van het nationaal octrooi, betreffende de werkwijze voor de bereiding van een geneesmiddel onder de naam Acidum nalidixicum, bestemd voor de handeling van infecties van de urinewegen. De vennootschap Sterling-Winthrop heeft in Groot-Brittannië een dochteronderneming. Centrafarm heeft uit Engeland en Duitsland volgens de geoctrooieerde werkwijze zonder toestemming van Sterling Drug het product in Nederland ingevoerd en daar in de handel gebracht. De geneesmiddelen waren rechtmatig in het verkeer gebracht door dochterondernemingen van Sterling Drug. De prijs van het product in Engeland lijkt half zo hoog te zijn dan in Nederland. Op 16 juni 1971 heeft Sterling Drug een kort geding aangevraagd aan de rechtbank in Rotterdam tegen het optreden van Centrafarm. De President van de Rechtbank wijst de vordering af op grond van een interpretatie van de Octrooiwet volgens welk product wordt geacht rechtmatig in het verkeer te zijn gebracht. Sterling Drug gaat in hoger beroep bij het Gerechtshof te Den Haag die Sterling Drug in het gelijk stelt. Centrafarm gaat tegen het arrest in cassatie bij de Hoge Raad. Alvorens de Hoge Raad beslist schorst de zaak en vraag het Hof van Justitie krachtens art, 177 van het E.E.G.-Verdrag uitspraak te doen.
