My name is ……..and I am writing to you on behalf of Ms. Patel to update you on the progress of your personal injury claim.
Ms. Patel has recently spoken with Aristotle PLC to agree on the amount of damages you should receive should your claim be successful. We are yet to agree on who caused the accident and whether or not your actions contributed to it however, we have agreed on causation and that the accident did cause your injury.
General damages
Aristotle PLC believed a starting figure of £3,000 for general damages was reasonable however, we felt £7,000 was more adequate. Having discussed previous cases relevant to your claim and, as a result of Aristotle PLC accepting that the accident caused the injuries you have sustained, Ms. Patel managed to successfully negotiate the figure to £5,350 to compensate for the pain and suffering you have been caused as a result of the accident. Should the matter proceed to court, there is a risk you will receive less damages and it could potentially be more time consuming and costly. For this reason we believe this is a very fair proposition and would recommend you accept the offer.
Acceleration period
Aristotle PLC has agreed that the accident caused the injury and that the degenerative condition you are already suffering from is likely to worsen due to the accident. We are in agreement that had the accident not have happened, the condition would not have worsened as quickly as the experts believe it will. Ms. Patel started negotiations on a 3 year acceleration period but Aristotle PLC believe due to your age, you have many more years within which you could suffer from other ailments therefore; a long period of acceleration is not relevant.
