Colossal Casino Case
Colossal Corporation’s (CC) goal is to uphold legal and ethical standards for the benefit of its stakeholders. However, a sensitive case ascended that involved the White Arch Casino (WAC) Manager, Sal Pending, and employee, Enoch Thompson, who was promised a promotion with a fifty percent raise and a five-year contract but was downsized before the contract was signed. The findings in this analysis revealed that Mr. Pending’s decision to downsize Mr. Thompson before the contract was signed were unethical and may imply a breach of contract and civil wrongdoings of the company. The Human Resources Department supports Mr. Pending’s decision to downsize apart from Mr. Thompson based on the promise set forth as an expressed or implied contract that was not signed.
Analysis and Findings:
Ethics is difficult to determine because the basis of what is ethical and unethical is so broad and involves the views of many people and their feelings. However, being ethical is not just based on what one feels but also doing what is right and within the parameters of the law. These characteristics combined are far more valuable. The usual method of showing mutual assent is by offer and acceptance. Second is the "Capacity", it means that the parties to a contract must have contractual capacity. Certain persons, such as adjudicated incompetents, have no legal capacity to a contract, while others, such as minors, incompetent persons, and intoxicated persons, have limited capacity to a contract. All others have full contractual capacity. Third is the "Legality of the object" the purpose of the contract must not be criminal, tortious, or otherwise against public policy.
