Construction Industry Regulation
Construction is big business, often quite literally. The construction industry is all about growing your business. A hiring a company that is properly regulated though possibly more expensive can be the difference between a new building that is perfect and ready to use and a muddy hole in the ground that is still waiting for work to be done. Construction companies are very heavily regulated because there is so much that can go wrong with the building industry. From the workers at ground level, to the person that buys the building from you 10 years down the line everyone needs to know that safety regulations have been followed and that this building will work for the intended function and location.

In Australia each state has its own laws regarding construction companies, though there is no central federal level governing body for construction companies usually their regulation is dealt with at a local city and county level. For example in South Australia it is the Office of Consumer and Business affairs that is responsible for overseeing building regulations and codes, whereas in the government of Western Australia it is Occupational Safety and Health (OSH)

Architects for example have their own governing bodies and separate insurance than that of the construction companies. Though this will be a different body per area their aim is the same so considering the OSH in regards to Western Australia will be our example. The Occupational Safety and Health office is in charge of making sure that everyone stays safe. They regulate everything from material handling, to the required clothing that construction crews must wear so that there will be as few accidents as possible. OSH also has to approve of the building plans if it is a commercial building so that once the construction has finished the new owners will also be up to their codes for their employee safety as

    The legal case in subject is with Williams Construction, a company that was under investigation after a trench collapse, which resulted in the death of Jose Aguiniga, and serious injury to Adam Palomar, two employees with Williams Construction.     The issue in this case is between the plaintiff, Leon Slavin, and the defendant, Joan W. Borinstein. Slavin is suing Borinstein over a dispute that erupted over payments on a construction project that were not received; on a project Slavin was building for Borinstein. Borinstein and her people agreed to pay Slavin 10 percent of the cost on a house they wanted to build in Los Angles. They would make the payments in installments. Slavin began to not receive payment for the appellant; then Borinstein’s lawyer tried to modify the contract mid project, therefore trying to reduce the amount owed to Slavin. The two disagreed, initially, however eventually thought they had come to terms on a modification. Soon after Slavin began to not receive payments for the second time, therefore he halted construction. At the time he halted construction the balance reached around $300,000. The rules that were applied are Civil Code section 1697, Civil Code section 1580, Civil Code section 1581, and last Civil Code section 1584. Each rule played its own part in the case and determining the conclusion. Code 1697 states that oral contracts may be modified; this played a role by allowing the respondent to claim that his oral contract was altered. Code 1580 talks about consent and how it needs to be mutual among all parties. This contributed to the case because the court came to the conclusion that the oral modification was not valid because it was not mutual. Code 1581 is relevant to how consent is to be given and communicated among all the parties. Lastly code 1584 states if a party acts on a proposal or states they accept a proposal then the proposal is accepted. This code was important because even though the counter modification wasn’t considered accepted, the initial modification was still effective because after the offer, Slavin continued the project.     OSHA stands for the Occupational Safety and Heath Administration, which is a US agency for the Department of Labor. OSHA’s priority is the safety of workers and health protection.
