Competition regulator urges buyer power

Jamaicans have been noticing that several of the grocery items they buy no longer look and taste the same, and several persons have taken their complaints of misleading packaging and falling quality standards to the Fair Trading Commission (FTC).
The FTC, as competition watchdog, can and does force food manufacturers to correct misleading representations of products where these are proved. But when the grouse is simply a matter of how the product 'tastes ', then it is up to the consumer to make the call whether or not to buy.
The FTC said it has been getting complaints alleging misleading representation of ingredients of certain food products.
In some instances, it said, the allegations were unfounded.
In others, due to the absence of industry standards, regarding definitions or classifications of certain foods and or ingredients, the allegations could not be proved.
One of the most recent complaints made against several bakeries related to bread labelled as 'whole wheat ', the FTC said.
Not all were found to have merit, but in some cases where packaging was labelled 'whole wheat ', a careful look at the fine print revealed that the major ingredients ranged from baking and enriched flour, to white flour.
The competition watchdog has raised its own concerns about the possible health risks of such a practice.
"The Fair Trading Commission was concerned that this misleading practice could pose a major health risk to some

    Menu Foods was the largest maker of wet cat and dog food in North America, and the company was identified as a supermarket, pet product retailer or wholesaler. In 2007, Menu Foods was part of a recall of up to 100 brands and 60 million cans of pet food, which was the largest pet food recall in history. On March 15th. 2007, the FDA, the Food and Drug Administration, initiated the pet food recall. But not until April did the FDA announce that it was an ingredient, wheat gluten imported from China that contained the melamine which led to a kidney failure. This contaminated food caused 100 pets to die by the end of March and caused nearly 500 kidney failures. Menu Foods’ crisis communication was ineffective in three ways: first, Menu Foods did not institute a product recall until March 16, 2007, 24 hours after the FDA initiated it, which demonstrated that Menu Foods lacked a quick response to the crisis; second, its CEO, Paul Henderson, lacked clarity in answering questions during the investigation, which demonstrated that Menu Foods lacked transparency; third, Menu Foods did not apologize to the public, which demonstrated a lack of concern and sympathy for the victims of the crisis.…

    They are only out for their own agenda and do not care about the unethical practices they are doing to make a profit. General Nutrition Center has a reputation for misleading the general public. In 2004, Abbey Spanier Rodd Abrams, LLP files a class action lawsuit on behalf of consumers against General Nutrition Center for violating consumer protection laws. This lawsuit was filed due to GNC having products in their store that had misleading labels. It was proven that some products they were selling did not contain the milligrams and products that were listed on the label (Marketing Weekly News, 2012). Misleading people has been a pattern for this company and has lead to many lawsuits by consumers and franchisee against the company. Under the Fair Packaging and Labeling Act, the company violated laws by misleading consumers and not giving accurate milligrams and ingredients that many of their products contained. This law was enacted by the Federal Trade Commission and the Food and Drug administration in 1967 to insure that companies do not falsify information of their products. Under the Consumer Product Safety Improvement Act, enacted in 2008 Gnc was in violation of misleading consumers about the products they were selling (Seaquist, 2012). This violated many tort laws put in place to protect consumers against this type of activity from happening. Many of the products were considered to be dangerous for consumers and had to be recalled for consumer protection. Gnc and companies such as Woodbolt Inc. were fined and sued for this violation. This is just an example of how GNC has misled people in the pass and are now misleading those who buy franchise store (Marketing Weekly News, 2012).
