Contract Reflection
After four weeks of studying, I found it that I am comfortable with week 2 and week 3, but I struggled with week 1 and week 4. Since my background is different from others, and China has few in common with the American law system, I found it very difficult to understand the law structure and the UCC sales. In the other hand, I had a few jobs in a special field, and I have run into some problems which are related to torts and contract, I think week two and three are more understandable for me.
The contracts that I have encountered with are work contract and lease contract. My very first job in America was working in a tribal casino as a dealer. Contract is following the federal or state statue, it is a very important role in the business because it is a basic rule to regulate employee. The contract I signed with the casino is under the protection of the federal government. The United States constitution provides for a federal government that is superior to state governments with regard its enumerated power. Therefore, whenever there is a conflict happened within the contract, we should look answers in the federal law instead of state law. In the other side, the lease contract is following the state law.
In the beginning the working, I received a book of gaming rule which tells us how to deal cards in the house way. The gaming book has a copyright which is the right of literary property as recognized and sanctioned by positive law. No one can publish it or use it on any purpose. Later on, there was an intentional tort happened. I reported my supervisor of sexual harassment, but he made a defamation statement against me saying I called him first. It damaged my reputation and indirectly caused the termination of my employment. The casino fired me of employment at will which they did not notice me in advance. Since I did not have implied the contract with them,

Contracts are essential in the business world and apply to both large and small businesses (Lau, 2011). Essentially, contracts are a legally enforceable promise to do something in exchange for something of value (Beesley, 2016). Elements of a contract formation include offer, acceptance and consideration (Colorado State University – Global Campus, 2016). Without proper formation, contracts can be invalid (Lau, 2011). The six elements of contract formation are offer, acceptance, consideration, mutuality of obligation, competency and capacity, and sometimes a written instrument (US Legal, n.d.). Contracts can be both bilateral, meaning an agreement between two parties, or unilateral, where action is taken by one party or group (Lau, 2011). This…

Waiting eagerly in our school garden, I was about to meet the five fourth graders that I was going to be grouped with for the rest of the year. I was a bit casual about the “meet and greet” because I could not determine how well I would fair with these little children. I could not predict whether these kids will enjoy my company or loathe it. After a lengthy thirty minute wait, the kids began to slowly flood onto the field. I was introduced to each student one by one and the first thought that ran through my mind was “How am I going to connect with someone who’s so different?” They were so reserved and quiet and I found it troubling having to find something to stimulate these them. My mind quickly jumped to all the basic questions to try to…

I asked what would her husband wishes would be and what he would want done in this situation? She still was unsure and then elected to maintain his code status to be Full Code. I found…

Since my last CAS reflection and meeting, the special needs cheerleading team that I coach has started practicing again. I plan to work with the team until the end of the season in May. The group of kids has grown from seven to twelve and I am excited for the new kids on the team. I hope that they will enjoy it as much as I do, and I know that I will be able to bond with these children just as I bonded with the children on the team last year. I feel that my leadership skills continue to develop and I step farther out of my comfort zone and help the children. The new team members have different disabilities than the children on the team last year, so I am working with them to understand what they are able to do and what they need extra help with.…

In the case of Pierre Konowaloff, Paris, France, v. The Metropolitan Museum of Art New York, New York, Pierre Konowaloff alleges that the Metropolitan Museum of Art acquired, displayed and retained a piece of art that was confiscated by the Russian Bolshevik regime from his great-grandfather in 1918. After gaining power in 1917, the Bolshevik regime issued decrees nationalizing property, and abolishing the private ownership of land and making museums property of the state. The Bolsheviks continued by confiscated artworks for possible sale abroad. In May 1933, Stephen C. Clark was a trustee of the Museum bequeathed the painting to the Museum after he died in 1960. The Museum of Art motioned to dismiss Konowaloff’s complaint, citing that the claims are barred by the act of state doctrine.…
