Contract Scenario
Recently, Danny Davidson sold a family home to his friends Paul and Priscilla Peterson whereby entering into a $250,000 verbal agreement for the purchase of new home. However, Danny neglected to tell Paul and Priscilla about Ned the neighbor and the emerging dispute pertaining to the boundaries of the south property. Once the purchase was final the Petersons proceeded to invest an estimate of $65,000 for landscaping as well as implementing a new Italian bathtub in the bathroom. As the Peterson’s proceed to upgrade their new home cracks developed in the new tile whereby causing the bathroom floor to sink because of a landscaping issue with the soil on the property. Subsequently, a breach of contract emerged whereby causing the Peterson’s to file a suit against their friend.
Valid or Invalid Contract “According to Kubasek, et al, legally binding contract must include the necessary elements “such as,” legal object, capacity along with consideration (2012, p. 306). However, in the scenario the couple entered a verbal agreement with a friend for the purchase of the home “thereby,” contingent on the information provided by a friend. The consideration estimated $250,000 for the purchase of the home. Nevertheless, neither of the entities were minors or endured some form of mental illness or legally intoxicated whereby indicating that each party was in complete capacity entering the aspects of a verbal agreement. Consequently, the contract was legally binding because the instrument met the necessary elements of the legal object, consideration, and capacity renders the validity of the contract enforceable.
Breach and Statue of Fraud Conversely, the agreement between Danny and the couple lacked the elements of genuine assent because of a failure to disclose pertinent information pertaining to the neighbor’s boundary dispute along with the

    Four elements are necessary for a contract to exist. According to Kubasek et al., (2012) “These elements are the agreement, the consideration, contractual capacity, and a legal object,” (p. 304). The agreement consists of an offer from one party and an acceptance from another. The agreement was to exchange the single-family home for $250,000. The scenario is unclear as to whether Danny or Paul made the initial offer. Either Danny offered to sell the home for $250,000 or Paul offered to buy the home for $250,000. The consideration is the bargained for exchange. The consideration in this scenario is Danny receiving the $250,000 and the Petersons receiving the house. Each party has contractual capacity as far as is stated in the scenario. Neither party was incapacitated, inebriated, or unable to make decisions due to mental or age restrictions. The legal object in the scenario is the house in exchange for the money. It is legal to sell a house for money so each of the elements of a contract is present even if a written contract was not present.     This is the story that I have witnessed in my community. The dispute between the boundaries of houses led to the misunderstanding of each other. Since I do not own any rights to appear theirs real name in this paper, let’s assume they are James and Taylor. James and Taylor were longtime neighbors and best friends before the dispute happened. One day, Taylor had done some changes in her front gate, which included laying a concrete slab. This concrete slab intruded on James’ property line. Taylor and James had many strong emotions about what was the best way to resolve this property line dispute. For Taylor it was only a few cm. But for James it was a very important few cm. James, concerned about maintaining his current property rights, insisted that Taylor to remove the concrete. Taylor felt that in the spirit of being good neighbors the cm should be overlooked. On the top of the issue, there was a third party, “the property line agency” that was called by Taylor to mediate this issue. James felt betrayed that Taylor had called the property line agency on him a few months earlier. Taylor had called property line agency to get help with the property line issue. Shockingly, while investigating the property line, the agent noticed that James had constructed a concrete grave of his father 5cm in the backyard of Taylor’s property land. James was forced to move his father grave from Taylor’s land. James blamed Taylor. Taylor hadn’t meant for that to happen. Then she understood James’ anger towards her. In the end, James and Taylor made several apologies to one another and let go these past transgressions. Concrete slab of Taylor was still constructed and James’ father grave was also not removed. As a result of the mediation, James and Taylor were spared the expense of the property line agency and more importantly, returned to being good…

    In this scenario, the parties agreed to an oral agreement in regard to buying the house. All elements were met to form a contract. First, Paul and Pricilla Peterson made a promise to buy Danny Davidson’s house for $250,000.00 and Danny accepted their offer. Second, consideration was an element in this agreement that a value was promised in exchange for the house and both parties agreed on the amount. Third, the acceptance of the offer was expressed through words and mirrored the terms of the offer to sell and buy the property.
