1) Identify the court visited and describe its general role in the English justice system.
On Wednesday 22nd of October the foundation group for law visited Uxbridge Magistrates court in The Court House, Harefield Road, Uxbridge. During the visit we recognised that the entrance moment is the moment that respect to the court should be shown. Initially, phones should be switched off then go through a security scan for safety issues. The building was divided in to more than one court room working simultaneously, thus saving more time by working on more cases together at the same time. He then states the main facts about the case. Furthermore to apply the legal actions from the legal point of view to decide the sentence to the offender. After sentencing the decision he then justifies his decision and the reasons for the imprisonment of the criminal. In other words also if he states probation or community service order for the criminal he must also state the reasons for his sentencing.
The Court Clerk role in court is as follows:
He works alongside the magistrates that are in control of criminal cases or specific civil proceedings providing advices compared to or linked to applicable law and judicial procedures. The clerk also assists the magistrate into providing them with guidelines on legal concepts which are relevant to the case being heard.
The Prosecutor role in court is as follow:
The Prosecutor in court is responsible in informing the court about all of the case facts. He also informs the court about any harm to any victim in the case. He assists the court in the sentencing scale, also identifying relevant case laws and legislation that is applied to the case. Furthermore he assists the court into sentencing the criminal with the suitable sentence applying the laws and regulations. In addition, he emphasizes the neutral phase or process that the court must abide to. The first case was about a problem between Mr David Jones Charles Pain and his ex-wife Mrs Condon which is under the criminal law. The incident took place on 6th of august which is after their separation by almost two months. The incident was that he had sent her an offensive disrespectful message using his own mobile phone. She discovered that she was pregnant after they have been separated and he was in a new relationship and that mainly caused the tension between him and his new girlfriend. He threatened her by his message trying to persuade her not to have the child and get an abortion. Then Pain called his ex-wife again using a landline phone and the threat was obvious this time. On the 28th of august, Condon’s mother have seen the message and was shocked of that attitude and being that offensive, and then she convinced her daughter to call the police since that the message and the phone call were both affirmed. Condon called the police accusing Pain for his guilty and he was caught by the police directly after that. During the trail Pain admitted sending the message and he pealed the guilty as he did not want anything to keep him on touch with her especially that he is entering a new relationship. He was left to go on conditional bail meaning that he was not allowed to get in touch with her at all, and in case if he does then he will have to suffer harsher consequences and
