Dearest Mr. & Mrs. Lee,

I know that this letter is very overdue and most likely unwanted, and may be seen as “a trap to try and convince people” (Sarah Koenig, Serial, Ep. 11, 33:34). I thought, since I have never provided you with my side of the story, you both may get a better understanding as to the reasons why I continue to maintain my innocence for the murder of Hae. Your daughter was a great part in my life, and although my words may mean nothing to you, I hope that you will hear the truth in my version of events and understand that I, too, am a victim in this tragedy.
I would first like to discuss the only “hard evidence” that the state has offered in convicting me of this murder; the outgoing phone call on my cell phone to Nisha Inez Butler on the day Hae was murdered. The state offered that my motive for killing your daughter was due to my rage after our final breakup. Prosecutor Kevin Eurig said: “He became enraged, he felt betrayed that his honor had been besmirched, and he became very angry, and he set out to kill Hae Min Lee” (Serial, Ep. 10, 12:56). I would just like to clarify that Hae and I had already moved on: I to Nisha, and Hae to Don, whom I had met and was friendly with. The state’s motive is really just something they scraped together to pin this murder on me.
When the outgoing call to Nisha from my cell phone was used to prove that my acquaintance, Jay, and I were together at the time of Hae’s death, I was immediately shocked as I was in school during that time. Sarah Koenig, the writer of Serial, who has been researching my case, believes she has found a few viable explanations as to why this call does not in fact link me to Hae’s murder. My 2:23 second outgoing call to Nisha went to her answering machine but Nisha said she didn’t have one. Koenig researched and found that I was charged for the call, supporting the fact that the call was unanswered, as it was over 30

    Facts: Kyle John Kelbel was convicted of first-degree murder, past pattern of child abuse, in violation of Minnesota state statute section 609.185(5) and second-degree murder, in violation of Minnesota statute 609.19, subdivision 2(1). He was sentenced to life in prison for the death of Kailyn Marie Montgomery. Kelbel appealed, and argued that the district court failed to instruct the jury that it must find that the state proved beyond a reasonable doubt each of the acts that constituted the past pattern of child abuse and he also argued that the evidence against him was insufficient to prove past pattern of child abuse against Kailyn. Kelbel testified that the head injury of Kailyn was inflicted by a cup thrown at her head by step brother Evan. Kelbel also testified that other injuries found on Kailyn were caused by Evan and that he is "rough" with her. Medical examiners ran an autopsy on Kailyn's body and determined that the injuries had been caused by blunt trauma and force caused by a knee or fist. Medical examiners testified that the injuries caused could not have been caused by a cup thrown at her head or by an accidental fall down the stairs. Kailyn's mother, Lindsey, also testified that Kailyn had previous injuries that she became concerned with. Upon retrieving a search warrant, police entered Lindsey's home to find further evidence. Police found a dent in the wall near Kailyn's bed.     But, what the defense failed to bring to the court's attention is that on a fax cover sheet discovered by Susan Simpson, AT&T clearly states that incoming call information is not reliable for location of the phone, negating the prosecution's use of it being a tracking device for Adnan. Those AT&T records said Syed’s phone “pinged” a cellphone tower covering the park and nearby areas during calls he received at 7:09 p.m. and 7:16 p.m. on 13 January 1999. The calls were described by Syed’s current attorney as “the pillar of the state’s case” against him. In a court motion filed last August, Syed’s attorney, C Justin Brown, said the disclaimer should have barred prosecutors from using the cellphone records.     Jay has been inconsistent with each story he has ever told. In each interview, he would change parts of the story he had previously shared. It is baffling to me that Adnan’s friend, Jay, a small town drug dealer, manages to convince the jury that he is a believable source in the murder case. It is likely that the reason the jurors had so much faith in Jay was because he was the only evidence the jury had to lean on. Other than Adnan’s handprint in Lee’s car, it would be ludicrous to say that Adnan murdered Hae Min Lee. During the first interview, Jay claimed that he heard Adnan say he wants to kill Hae Min Lee, then the next day he was shown Lee’s body and Jay helped Adnan get rid of it.
