Demeter Case Brief
MILLERSBURG — A warrant has been issued for the arrest of a Lakeville man who admittedly was in illegal possession of weapons during and following a road rage incident that culminated in the firing of several rounds from a gun, but failed to appear for sentencing Thursday.
Joesph R. Demeter, 34, of 7041 Township Road 466, Lot 22, previously pleaded not guilty in Holmes County Common Pleas Court to having weapons while under disability and aggravated menacing. In exchange for his guilty plea, two similar charges were dismissed by the state.
Demeter faces up to three years in prison and six months in jail for the charges.
In court, Demeter's attorney, Kenneth Lewis said he has not had recent contact with Demeter, whose phone appears to be turned

The shots came following a verbal confrontation, according to Chief Deputy Richard Haun.
According to the victims, Demeter shot multiple times from the handgun, an allegation supported by the discovery of seven spent 9 mm casings found in the area identified by the victim, according to an affidavit of probable cause filed with the Holmes County Municipal Court.
While Demeter was gone when the deputy arrived, he later returned, but denied the allegations, although a magazine was recovered from his vehicle, said Haun.
Demeter immediately was arrested for drunken driving and later was charged with possession of the gun and ammunition, as well as a .223-caliber rifle, a .22-caliber rifle, an air rifle, a .22-caliber rifle and a second 9 mm handgun located in his home
According to the criminal indictment, Demeter is prohibited from their possession in the wake of a 2007 conviction for a felony drug offense and domestic violence and attempted domestic violence, in 2004 and 2011, respectively.
