You should now be familiar with two Supreme Court cases related to the Eighth Amendment and juvenile law. Now you will use what you've learned to write an extended response to the focus question. Imagine your state is having voters decide the issue of whether to allow juveniles to be tried and sentenced as adults. The local newspaper has asked students in your course to submit an article on the topic to give minors a voice in the debate. The editor explains that your audience includes voting adults who may be undecided on the issue. Your job is to write a persuasive article to convince them to your side.

Your article will be graded on content and quality. Be sure to use facts and quotes where appropriate to explain or justify your claim. Relate court cases that you have learned about to each other and refer to what you have learned in lessons. You may use this template to organize your article.

"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."
—Eighth Amendment to the U.S. Constitution Morris Kent was 16 years old when police arrested and charged him for multiple counts of burglary, robbery, and rape. The teen was already on probation in Washington D.C. for prior burglaries and theft. The prosecutor on the case wanted Kent's trial to happen in adult court. His reasons included Kent's criminal history and the serious nature of the current charges. Kent's lawyer, of course, wanted the case to stay in juvenile court. Had the judge allowed a hearing, Kent's lawyer would have argued that his client was mentally ill. He would have said this fact should be considered before determining which trial court to use. Yet the judge made the decision without holding a hearing. The adult court tried Kent and found him guilty of the charges. His sentence was 30 to 90 years in prison. In his appeal, Kent argued that the case should have stayed in juvenile court.
The Supreme Court did not agree with Morris

Each student will present a written case analysis which should be no more than 5 and no less than 4 double-spaced pages and is due on the date and time indicated in the course schedule (last page of this syllabus). While I focus on the content of your essay for my grading, clarity of presentation and organization is essential for me to follow your ideas. A good starting point is to look at the case discussion questions in Quiz 4. But your answer cannot be a series of answers to questions but must rather be an essay. Some of these questions will guide your case analysis and should be an aid to you in formulating your answer. Therefore, reading the case before the end of the third week so as to deal with these questions should help you do well in the case project. A good approach to the project is to make sure you include all the elements that I look for in my grading of your assignment.…

Kent's lawyer sought to have the criminal indictment dismissed, arguing that the waiver had been invalid. He also appealed the waiver and filed a writ of habeas corpus asking the State to justify Kent's detention. Appellate courts rejected both the appeal and the writ, refused to scrutinize the judge's "investigation," and accepted the waiver as valid. In appealing to the U.S. Supreme Court, Kent's attorney argued that the judge had not made a complete investigation and that Kent was denied constitutional rights simply because he was a minor.…

PLEASE READ: This is a list of LEGAL research that you may use for your memorandum assignment. Not all cases, statutes, or regulations need to be included in your paper. Keep in mind that secondary sources are only a guide or an explanation of the law. You should always place greater emphasis on primary authority over secondary authority. Use your judgment as to what you should include in your memo. Avoid redundancy if there are numerous cases covering the same issue or have similar facts. Pick the best source, if that is the case. Also remember that constitutional provisions and statutes have greater importance than case law.…

Criminal defendants have several constitutional clauses that protect defendants from excessively severe or uncommon punishments. Most of these restrictions can be found in the Eighth Amendment. The Eighth Amendment states that in a criminal case, “excessive bail shall not be required”, “excessive fines shall not be imposed”, and “cruel and unusual punishment shall not be inflicted”. This is important because it restricts the court from issuing a punishment that is not fitting for the crime.…
