Discrimination

Discrimination is different treatment of individuals or groups based on, race, ethnicity, sexual orientation or economic status instead of treatment based on the actual behavior or qualifications of each individual. The forms of discrimination in the criminal justice is systematic discrimination, institutional discrimination, contextual discrimination, and pure justice. No matter how you try to twist these terms there are still considered as discrimination.

Institutionalized Discrimination concerns disparities in result than through policies. The main element of institutionalized discrimination is result; not race. Contextual Discrimination is discrimination that is found in some places at certain times, and in some contexts. Systematic Discrimination occurs when a particular race, gender, age, ethnicity or life style group encounters discrimination in every stage, every stage of the country without variation. The final concept is pure justice and that indicates discrimination does not exist at any time or place in the criminal justice system.

Disparity Disparity is the unequal treatment of members of one demographic group by the criminal justice system compared with the treatment accorded members of other groups. There are also some explanations for disparities. As I get further into my paper I will list some of them. Then you will see the true meaning of disparities. The explanations are as follows:
➢ People of color are commit more crimes.
➢ The Criminal Justice system is racist with the result that people of color are treated harshly.
➢ The criminal system expresses racism found in society as a whole.

Disparity and Discrimination Unlike Caucasian; Hispanics, African Americans, and other minorities are subject to the criminal justice system at a much higher rate. They are the ones that are most likely to get in trouble with the law before any group. You don't hear about too many Caucasians getting in trouble with the law.

 African Americans accounts for 28 percent of all arrest and there is more than 1/3 of them locked up in the United States. There are only 13 percent of the people in the U.S is African American.
 The per capita incarceration rate for the African Americans is more than 6 times greater than that for the caucasian rate.
 Since 1980 the proportions of Hispanics locked up has risen from 7.7 percent to 21.0 percent
 The rate of unfounded arrest of Hispanics in California is double that of Caucasians.
 Among every 100,000 African Americans in 2007 nearly 20 were killed by gun compared with 9 gun deaths among every 100,00 whites.

As far as example cases for these two terms they are as follows:
➢ Trayvon Martin Case
➢ The shooting of the young black man in Valdosta
➢ Kendrick Johnson, 17, was found dead in a rolled-up mat a high school gym
➢ LAWRENCEVILLE, Ga. (AP) -- Police say the body of a 10-year-old girl has been found in a trash can at a metro Atlanta apartment complex

This sums up my paper on Discrimination and Disparity. I know that you may not understand the difference between Discrimination and Disparity but if you pay attention to your everyday surroundings it happening all around you. I know at times that these are two things that we avoid trying to see but at the end of the day we got to accept the fact that these are part of our everyday lives. I know that some people just don't care but we can't keep ignoring the facts that telling and showing us whats really going on out there in our society and the criminal justice system can do one or two things; which are make it worst or make it better. We can fight to try and make these two issues go away but at the end of the day they still have to be dealt with whether they like it or not and that's just the way things are. So lets stop fussing and fighting about what's going wrong in our society and put toward an effort to fix it or make it better.
