Case Description The subject of the meeting for the Behavioural Intervention Plan (BIP) is Asher Collins, a 12-year old African-American male student at Caledonia Elementary School in Caledonia, Mississippi whose parents have recently gotten a divorce. School records coupled with other information sources reveal a long history of disciplinary issues and poor academic performance. These reports indicate that this student has had repeated incidences of class disruption in addition to showing aggressive behaviour and being non-compliant even to the school staff. While it may seem as if a child’s challenging behavior serves no purpose other than to disrupt the classroom this is not the case. Challenging behavior always serves a purpose and meets a need that the child has. These needs include getting reinforcement (social or tangible) or escaping or avoiding a task or situation (Functional Behavior Assessment, 2001). Well to start I do not agree with the standard testing. All children test and learn differently. The standardized test can assist one child and hinder another. Also the 0% tolerance should always be reviewed on a case by case basis. Now most school districts offer alternative schools for those youth who have been expelled from the general school system. This alternative is more like a second chance if the student really wants to change. I believe that we (school district) should promote and support more qualified teachers and counselors this could get to the root of the disruptive behavior. School institutions simply cannot tolerate misbehavior by students. It is the school’s responsibility to maintain a safe, and controlled learning environment for everyone within the school institutions. Students truly cannot learn and teachers cannot teach amongst disruption and chaos. This is no controversy. So, to try and achieve this goal, schools have adapted and fiercely implemented the zero tolerance policies. Schools feel these policies have made them more effective in handing disciplinary issues. It mandates a consistency of discipline for certain offenses. Parents feel the zero tolerance policies ensures the safety of their children while at school. Schools are in great need of systems, processes, and personnel who are able to support the needs of students with problem behavior. Research indicates, however, that (while I am a big, fat cheater) information has not been made available to teachers and other professionals in a format that allows these strategies to become common practice. As a teacher I have the responsibility to teach my students while maintaining a safe learning environment, this includes both physical and mental safety. The best way to do this is by clearly posting and discussing the rules and rights for students in the classroom, and the consequences for breaking them. Giving this same information in handout form that needs to be signed by parents and students will ensure that everyone knows what is to be expected of them. This will influence the students’ rights by letting them know that even with the right to free speech, there is a time and place for everything. Although every student has the right to an education, if one student becomes disruptive enough to threaten the safety of the classroom removal of that student may be necessary. It is unfair to the other students who adhere to the classroom policies to be punished for one student’s misconduct. Although many claim that the zero tolerance disciplinary policies violate the constitutional rights of students, U.S. courts remain submissive toward the jurisdiction schools have to enforce disciplinary action (Aull IV). Even though African American students who are suspended or expelled as a result of the zero tolerance policy have the constitutional right to the Fourteenth Amendment (due process and equal protection), it is difficult to challenge the discriminatory action due to the zero tolerance policy’s defined motive against misbehavior at school (Aull IV). The role of a school is multi-faceted. It exists not only to educate, but to guide children’s development into well-adjusted, independent, and successful adults. In order to offer support and time to a class in its entirety, pupil behaviour needs to be managed effectively. Boundaries and rules need to be set for children and a consistent approach applied by all staff. Documented policies and procedures enable all to have a clear understanding of expectations and common goals.
