In Nova Scotia, Sydney there was a man by the name of Donald Marshall. Donald Marshall was 17 years old, and at that time it was hard to earn money and or find a job, especially for a First Nation's person. Donald's father at most got food and supplies rather then money as a earning. His father installed drywall in houses or buildings as a career. Donald supported his father sometimes as well. His mother was a cleaner at the hospital, but soon became a house maid.
Racism was a big factor at that time. Police would take in others for custody due to minor reasons and or no reasons at all. It all depended upon whether if they liked you or not, it also depended on your race. The First Nations people were put into a reserve named after their chief. They were known as Mi' Kmaq. If a First Nations was out of their reserve they would be treated with disrespect and cruelty. There were many flaws and systemic racism in the justice system. As a First Nations person Donald felt like an outcast.
On May 28, 1971 Donald received $20 from his father to go to a party. As Donald was walking to the party he met up with an old acquantance “ 17 year old, Sandy Seals”. He met Sandy at Wentworth Park. Sandy claimed he had just come back from the party, because the tickets were sold out. As they were talking Roy Ebsury (former ship's cook), and Jimmy McNeal (unemployed laborer) who were also there at the time asked Sandy and Donald for a cigar. As Donald and Sandy approach the two men to give them a cigar, Roy asks for them to come and join him at his house for a drink (alchohol). Sandy and Donald refuse and Roy walks off with Jimmy. As he approaches Sandy, he stabs him in the stomach and tries to do the same with Donald, except Donald blocked the knife with his hand.
