Dov Charney's Criticism Of American Apparel
There has been sexual harassment lawsuits filed against Charney, in which he denies (Smith). He was an amateur pornographer and uses his ‘expertise’ in his ads (Smith). He has had workers working for him that were unable to supply proper working papers (Clark.) “Legalize LA’ is a campaign started by the company (Showcase & Discover Creative Work). These are all factors that result in much criticism of American Apparel.
For Dov Charney, walking around the office in his underwear is normal. However, for everyone other than Charney, this is abnormal behavior. According to Charney, he frequently drops his pants to ‘market’ his new products (Mankiewicz). Dov Charney has faced quite a few lawsuits for harassing sexually harassing female employees. It shows in the lawsuits filed against him accusing him of sexual harassment, and it certainly is seen through advertising for the company. American Apparel is definitely not afraid to show a little skin in advertising. If an individual were to look at an American Apparel ad without knowing what the company is or their ‘style’, one might be appalled. A number of ads for the company show young girls practically naked, in a provocative style. There are a few ads that show women in thong underwear or even shirtless. In Britain, the Advertising Standards Authority has banned numerous American Apparel ads after receiving complaints that the photos in the ads were “pornographic, exploitative of women and inappropriately sexualized young women” Krupnick). The ASA decided to ban the photos because of nudity and a few for being exploitive (Krupnick). While the ads for American Apparel are extremely provocative and can be seen as offensive and exploitive, there are no signs to show that Dov Charney and his company will change their style of

    Peter Oiler’s termination from his job by the Winn-Dixie Corporation was an outright and blatant violation of his employee rights. No company or organization is allowed to discriminate against an individual on the basis of sexual orientation and they are most certainly not allowed to discriminate against an employee due to the way he/she decides to dress. This decision would be akin to firing a woman truck driver for wearing a flannel shirt and a pair of jeans while off-duty; while this would be unheard of, the decision to fire Oiler based on his choice of wardrobe while off the job is absurd and completely unfounded. Oiler had a spotless record during his numerous years working for Winn-Dixie; he was basically the perfect employee and to violate an individual’s employee rights and invade his privacy as the company did exhibits a degree of narrow-mindedness and bigotry which is reminiscent of the Dark Ages.     The legal issues in this case are: there is anywhere from twelve to twenty million illegal immigrants residing in the United States illegally. As far as the ethical issues in this case, well there are so many issues I wouldn’t even know where to begin. The fact that any business would intentionally make their working environment and so poor knowing that only illegal immigrants would tolerate working there without reporting it to any agency or the legal system is beyond unethical! Now that the legal system only requires employers to use the “E-Verify” system rather than making any illegal immigrant/person provide hard copies of their citizenship. Proof of legal status can now be passed off with false names that are given to employers make our government act irresponsible which causes them to not act ethical. The information that the person provides the employer may check out in the system but in reality is not legit; and is often overlooked because it can be without consequences to the businesses. Any business that would “depress” wages so low that it causes the people who legally reside in the United States to take a huge decrease in pay because illegal immigrants that “check out” or not… are willing to work for a lot less than what the company previously paid out in salary by “overlooking” the fact that they are really just paying lower wages to undocumented workers and taking jobs from legal citizens is unethical and just bad business in respect to our US economy.
