elcano vs. hill case
ELCANO V HILL
77 SCRA 98BARREDO; May 26, 1977

NATURE
Appeal from an order of the CFI Quezon City

FACTS
Reginald Hill, a minor yet married at the time of occurrence, was criminally prosecuted for the killing of Agapito Elcano (son of Pedro), and was acquitted for ―lack of intent to kill, coupled with mistake.‖ - Pedro Elcano filed a complaint for recovery of damages from Reginald and his father Atty Marvin. CFI dismissed it.

ISSUES
WON the civil action for damages is barred by the acquittal of Reginald in the criminal case wherein the action for civil liability was not reversed2. WON Article 2180 (2nd and last par) of the CC can be applied against Atty. Hill, notwithstanding the fact that at the time of the occurrence, Reginald, though a minor, living with and getting subsistence from his father, was already legally married.

HELD
1. NO

The acquittal of Reginal Hill in the criminal case has not extinguished his liability forquasi-delict, hence that acquittal is not a bar to the instant action against him.-
Barredo v Garcia
(dual character

civil and criminal

of fault or negligence as a source of obligation):"The above case is pertinent because it shows that the same act may come under both the Penal Code and the Civil Code. In that case, the action of the agent was unjustified and fraudulent and therefore could have been the subject of a criminal action. And yet, it was held to be also a proper subject of a civil action under article 1902 of the Civil Code. It is also to be noted that it was the employer and not the employee who was being sued.""It will be noticed that the defendant in the above case could have been prosecuted in a criminal case because his negligence causing the death of the child was punishable by the Penal Code. Here is therefore a clear instance of the same act of negligence being aproper subject matter either of a criminal action with its consequent civil liability arising from a crime or of an entirely separate and independent civil action for fault or negligence under article 1402 of the Civil Code. Thus, in this jurisdiction, the separate individuality of a c quasi-delito or culpa aquiliana under the Civil Code has been fully and clearly recognized, even with regard to a negligent act for which the wrongdoer could have been prosecuted and convicted in a criminal case aria for which, after un a conviction, he could have been sued for this civil liability arising from his crime.‖ -
Culpa aquiliana includes acts which are criminal in character or in violation of a penal law, whether voluntary or negligent.-ART 1162: "Obligations derived from quasi-delicts shall be governed by the provisions of Chapter 2, Title XVII of this Book, (on quasi-delicts) and by special laws." More precisely, Article 2177 of the new code provides:"ART 277. Responsibility for fault or negligence under the preceding article is entirely separate and distinct from the civil liability arising front negligence under the Penal Code. But the plaintiff cannot recover damages twice for the same act or omission of the defendant.

I believe this case should be decided in favor of the petitioner. The Briseno factors, used in this case resulted in the wrongful sentencing of an intellectually disabled man. The Supreme Court should accept this case and extend its ruling in Hall to the second prong of intellectually disabled. The determination of intellectual disability should follow clinical standards and not the stereotype of an intellectually disabled person a jury may have. The Supreme Court is being presented with an especially egregious case, in my opinion, as it seemed both petitioner and opposition believed Lizcano had adaptive behavior deficits. The jurors incorrectly weighed Lizcano’s strengths against his weaknesses although this is not recommended by clinical…

Punishment is the outcome to every wrong doing someone does. However, there's usually a loop hole to a crime that ends up changing the final sentence . In the case of Carmell Vs. Texas, the crime that the defendant was charged on, had occurred during the time in which the state of Texas had changed the law on the action he was accused for commiting. All Scott Carmell needed to avoid life in prison for sexually assaulting his stepdaughter was a good lawyer. It is often difficult to ascertain whether a given change in the law hurts the defendant, helps him, or is neutral. But for Carmell the law spoke in his favor.…

So once her boyfriend broke up with her, Elle went and join Harvard Law School, in order to get Warner back. Once into Law School, you can’t miss all the disputes, self-disclosure, and power amongst each characters. In UK law, there is generally no criminal liability for a failure to act. The exception to this principle is in situations where the defendant had a legal duty to take positive action, but failed in this duty. There are five situation where a person is duty bound to act otherwise he may be criminally liable. Like where a defendant was duty bound by a specific statue or law to act but willingly does not do so, is liable of an offence as in the case of Dytham. Another is if a person is bound to act according to law where he/she has gone under a contract, often relating to their employment. It is their obligatory and statutory duty to act according to law which happened in the case of Pittwood. Another situation is where a duty arises from a relation, there are two types of relation among the people on is by blood and the other is by subsequent relations. Usually parents are duty bound to take care of their children as seen in Gibbons and Proctor. Reliance or voluntary responsibility is if a couple takes a duty of care for a child to look after him and they are being paid for it that is called contractual duty on the other hand where a couple assume a duty of care towards there vulnerable relative they assume a duty of voluntary responsibility to look after him and take care of him, failing to do so they may be charged for criminal offence. This happened in the case of Stone and Dobinson when they took the responsibility for caring for a sick relative. Finally there is a duty arising from commission of a fault. For example if D is has created an unlawful situation without any mens rea but is still responsibility for such act and, they deliberately refuses to deal with the situation and make it safe, then they are surely liable for that negligence as was the case with Miller.…
