Dear Mr. Rodriguez,
Five weeks ago, on February 14th, I placed an order for double glazed, made to order, oak French doors, for my client over the telephone. When they arrived five weeks later I was surprised to find out that the doors had been cut to small. Instead of measuring 11 feet 8 inches wide as I specified, the doors measured 11 feet 4 inches wide. My client wanted the doors installed immediately, so I had to pay my carpenter $376 to rebuild the opening.
Seeing as I am a long standing client and in fact, saved you a lot of money by not returning the doors, I would like to be reimbursed for the additional cost. Enclosed with this letter is a copy of my carpenter’s bill. As the order was placed on the phone, the door invoice doesn’t state the measurements, still I have included it in this envelope. I look forward to the speedy resolution of this manner.
Best,

Response:
Dear: Ms. Olmstead,
I have reviewed the letter and additional information you sent me regarding your order on February 14th. We understand that your client wanted the doors installed immediately, thus you couldn’t return them, leading you to pay a carpenter to fix the problem. That being said, we have a very strict no refund policy. Since this is a unique case and you are a frequent customer, we are willing to credit $367 to your account for any future purchase from Capitol Lumber. I hope this is a reasonable solution, and we look forward to doing business with you in the future.
Thank You,
Sal Rodriguez

Mr. Ralph Gough was under a preexisting duty to construct the trusses for the Kinney shoe store. The general contractor, Chuckrow, was never obligated to pay for the re-erection of those trusses no matter who’s fault if they fell according to the original agreement. Mr. Gough 's preexisting duty cannot operate as consideration or change Chuckrow 's offer to pay. Therefore the contract was not modified, and Chuckrow is obligated only for the original contract price. Hence Mr. Gough cannot recover the funds. (Robert Chuckrow Construction Company v. Gough, 1968)…

You work for JPM, Johnson Property Management, in Portland, Oregon. Your employer specializes in commercial real estate. Yesterday one of your business tenants in the trendy NW 23rd neighborhood complained about problems with an iron gate you had installed by Chung Iron Works just six months earlier, on August 20. Apparently, the two doors of the gate have settled and don’t match in height. The gate gets stuck. It takes much force to open, close, and lock the gate. The iron gate was painted, and in some spots rust is bleeding onto the previously pristine white paint. The tenant at 921 NW 23rd Ave., Portland, OR 97210 is a petite shop owner, who complained to you about struggling with the gate at least twice a day when opening and closing her store.…

For this reason, it is a good idea to have a repairperson put their services and costs of supplies in written contracts. For example, when I needed to have my house painted, I asked a friend for a recommendation. I requested that the handyman she suggested write me out a contract for the work. He performed the job satisfactorily. Then, I asked him to install a handrail. We talked about his service and the cost of supplies, but I did not ask for a written contract because he had done work for me before and the new job was a small one. However, when he performed the work, the rail was not steady. I repeatedly asked him to correct the problem. Finally, he fixed it and he asked me for more money because he said that he lost money on the deal, but I refused to pay him anything else. He kept trying to get more money and I told him that he was trying to take advantage of me. I had to abruptly end the conversation and move on. Now, I cannot hire him for future work. Perhaps if I had asked him to write out a contract for the handrail, the outcome would have been…

I absolutely had to use a photo of Princess Diana because I was a huge fan of hers. I remember watching her wedding on television when I was a young child, and I cried like a baby when she met her untimely demise. I don't recall every crying like that when a celebrity died, but she was my heroine and I loved her! Since then I've kept up with the ins and outs of the Royal Family and the shenanigans of Prince Harry, my now favorite Prince. He is a Princess Diana reincarnated in the male form. Lives by his own rules and with not a care in the world. Madison and I were able to visit the Madame Tussauds London museum while on our trip to London just recently, thanks to the kind folks of Merlin Entertainment. Since this is most likely the only way we'll ever get to the meet the Royal Family we just had to do it. Now if you're thinking all wax museums are the same, well Madame Tussauds London is on a whole new level of awesome. I've…
