1.) Keeping in mind the facts and timeline of this situation, discuss Jackie’s situation in term of its legal and ethical issues.
Jackie’s ethical issue was that she slept and carried on a relationship with her manager Curtis. As far as legal issues, if Jackie was to go through with the information she was telling Leslie, she would be disciplined because of the employee ethics code.
2.) Discuss Jackie’s alternatives and the possible professional and private outcomes of her situation.
Jackie’s alternatives are to stay with the SDR and to continue her work or to file a case against Curtis for his harassment. If she decides to go against Curtis she could sacrifice her career because he knows a lot of high people in the music industry.
3.) Is Curtis in violation of sexual harassment and/or sexual discrimination laws in the United States?
Yes, Curtis is in violation of sexual harassment laws in the United States. There are 3 criterions for establishing sexual harassment which are:
1.) The conduct was unwelcome
2.) The conduct was severe, pervasive, and regarded by the claimant as so hostile or offensive as to alter his or her conditions of employment; and
3.) The conduct was such that a reasonable person would find it hostile and offensive.
In this case Curtis was making unwanted sexual remarks to Jackie. He made these remarks not only in private but in front of her band members. This behavior from Curtis was affecting Jackie’s work because she couldn’t concentrate. She would get shaken up when Curtis would make these remarks which affected her work. The sexual words that Curtis was using made Jackie feel uncomfortable which made for a hostile work environment.
