|The ethical issue that is presented is the officers know that the husband was driving while intoxicated; they know that he has |
|lied, and they know based off of the 911 call that the wife was abused. The law states that nothing can be done because nothing |
|was observed. |
|What are the most important facts? Which facts have the most bearing on the ethical decision presented? Include any important |
|potential economic, social, or political pressures, and exclude inconsequential facts. |
|The most important facts are that the husband has an alcohol level of 2.0 which is two times the legal limit, the hood of the car |
|was hot, but when asked the pair said the car had not been driven in at least four hours. Also, that the wife had made a 911 call |
|saying that abuse had occurred, but there are no visible marks to the officers when they get there. The facts that have the most |
|bearing are that the car hood was hot, she had stated that her husband had taken off and that she was concerned, the husband had |
|dropped the keys when observed walking up the sidewalk, and that he had an alcohol level of 2.0. Officer Nixon is a 20-year |
|veteran and has seen this situation before and knows what the laws are, while Officer Rock is just starting and may be eager to |
|jump. But the law clearly states that the officer has to observe an individual committing these crimes in order for there to be an|
|arrest. |

    Since 1982 National Highway Traffic Safety Administration (NHTSA) has been tracking the statistics related to drunk driving. Each year the in some way the percentages increase. The year 2009 alone was 29% greater than the year of 1982, causing it to raise concerns for citizens but failing to raise them with the state and federal legislatures. There are even groups that have emerged that represent families that have lost a loved one in an alcohol-related traffic fatality. They feel that there should be legislature against tougher penalties for drunk drivers. The First-Offense of drunk driving is a forfeiture but not a crime. A forfeiture is punishable by loss of money, where as a crime is punishable by loss of liberty or incarceration. In the Supreme Court case Missouri v.
