All these situations are enough to make Charles a very agitated man who is willing to do anything to defend himself and rightfully so. So, upon returning to the house and a second fight ensuing, things went too far and guns were involved. It can, therefore, be argued that from the previous fight, Charles was already in defense mode which will justify his actions when he was attacked the second time. After the shots were fired and the injured and deceased were sent to the hospital, Toxicology reports taken during Darrin Cain’s autopsy show that Darrin consumed cocaine and alcohol prior to his death. This is enough to support the claim that Darrin was on the offensive and that Charles only acted in self-defense. It is a common case that people intoxicated with alcohol and especially cocaine can be very unruly. Darrin’s death, however, can be seen as a result of a medical malfunction. Denise Hayslip’s brother testified in a trial that a nurse from Hermann Hospital indicated to him that Denise would recover from her wound.
Based on her experience seeing hundreds of similar cases, the nurse explained, the wound was not life threatening. Negligence on the hospital staff in caring for Denise resulted in her death. Her death could be said to be accidental since she happened to be there while the fight ensued and was not taken proper care of at the hospital. The state's charges for capital murder was rather too aggressive and deserved a lesser charge. Charles might have injured Denise but he certainly does not kill her. Also, the doctor performing on Denise was not experienced enough for the job, and sources said he lied during a job interview about his experience, which means he does not know the job well enough to be performing on patients. Obviously, all this evidence were hidden from the court. In other words, he was not presented because Charles was assigned an inexperienced lawyer and did not have enough time for his defense. Charles should not be convicted for Denise’s death. If she had died while going to the hospital or even before the doctor does anything, then yes he would have been guilty of her death. Also, due to brady violations discovered and the limited time giving to Charles council to properly prepare and defend him means he was short-changed. In all the state was eager to charge him and find him guilty for the deaths of Darrin and Dennis and
to be sentenced to death.
It is a clear case of how the criminal justice system has issues and can be problematic. In all, Charles could have been wrongfully sentenced to death and the lack of time for a good defense and evidence gathering which was denied could have made a difference in the case, and he would probably be sentenced to years or life in prison instead of a death sentence.
