For the last few weeks I made it my priority to attend as many court cases as I possibly could in order to fulfill the requirements for this paper. There were many challenges as there were at least five trials that I planned to observe that resulted in a continuance. Either a witness that was under subpoena failed to show, a party needed more time, the counsel’s health was affected and even when there wouldn’t be enough time during the trial court’s term to complete the trial. As frustrating as this was, these types of things should be expected and the result of this could be a large factor in the reason why our court systems are so congested, as we talked about so often in our online discussions. I decided to write my observation paper on the cases that I found most interesting and that I could fully analyze.
The first court case I observed was Castle Rock, Colorado at the Douglas County Courthouse in the 18th Judicial District. I attended the hearing on October 8th at approximately 1:30 P.M. I observed Judge Richard Caschette in the district court jurisdiction. He then conversed with the prosecuting attorney if there was any disagreement which there wasn’t and he finally accepted the plea of guilty as entered. The judge then conversed with both parties as to the date and time a sentencing hearing would take place. After naming off a couple dates and times by the judge, both the prosecuting attorney and the defendant’s attorney came to an agreement and sentencing hearing was set.
