Neonaticide was a term founded by Phillip Resnick, which by definition means the circumstance when a newborn is killed by the parents within 24 hours after birth. Neonaticide was around way before Mr. Resnick coined the term and making it a national debate on whether it should or should not be a criminal offense. This act of killing babies during the first 24 hours of life came from England and was in the American Colonies. Based on the, “In 1646 the General Court of Massachusetts Bay had enacted a law where "a stubborn or rebellious son, of sufficient years and understanding, " would be brought before the Magistrates in court and "such a son shall be put to death." Many Philosophers argue that insanity is one of the reason for this to occur and insanity is not a criminal offense. Many of the people that are found to have committed the crime say, that they are insane because they had the struggle with hiding the fact of the pregnancy and not being mature enough to realize the situation. People who commit this action are teens or women who deny that they are pregnant and in some cases pass out in labor, leading to the baby dying from neglect. This fact is also a leading topic for those who believe that it should not be a crime, because they say that the women had no real way of saving the baby because they were by themselves and hiding their pregnancy. Unfortunately this hiding of a pregnancy, can be cured in a legal way by getting an abortion. Women might be afraid to go into the clinics to discuss the options of abortion, but it is a legal way to terminate a pregnancy without killing a child after being born. There also used to be legal abortion called partial birth, and that, “ Is a method of late-term abortion that ends a pregnancy and results in the death and intact removal of a fetus from the uterus.” This form of abortion was a very good argument for Philosophers, because it was a partial born baby killed legally Philosophers see this a just couple of minutes, meaning partial birth is legal, yet killing a baby within 24 hours is illegal. This was then made illegal in 2003, with the federal Partial-Birth Abortion Ban Act. This rendering the argument of partial birth being a baby being born and then killed in the process, with this similar to a
