According to the fact of this case, Parent Co. (Parent) wholly owns Poor Son Co. (Poor Son) as a legal subsidiary, and both of them all nonpublic companies. However, in January 2007 Poor Son filed a voluntary bankruptcy under Chapter 11 of the U.S. bankruptcy code because of its inability of meet obligations as they became due. Then, Parent claimed the loss of control of Poor Son and deconsolidated Poor Son from its financial statement. No monitoring or supervisions of the clocking in process. This means that employees can abuse the system as proven by the worker caught clocking in his colleagues. This means that employees are being paid for work they are not doing. This will increase the payroll expense as more hours will be needed to complete the same level of work. It could also push back targets, with the possibility that it could cause delays in Chuck Industries shipping out products to customers. It may also lower morale in among employees who work hard and follow company protocols, if they see colleagues getting away with abusing the system, they may decide to follow suit. There is also the possibility that colleagues could be clocking each other out hours after leaving work, to try and get unauthorised overtime, increasing the payroll spend for the company…

The prosecution case against the main suspect, Michael Shirley, consisted of four circumstantial pieces of evidence. Forensic evidence is evidence obtained by scientific methods. In the case of Linda Cook, methods used included extracting impressions and DNA. An Athletic shoe impression was found on Cook’s abdomen, sizing at 43-45 and was the right foot. This shoe had a distinctive tread pattern including the obvious impression of the word ‘Flash’ located in the heel. The suspect owned a pair of size 44 athletic shoes with the same tread and stated that he “may” have been wearing them on the night of Linda Cook’s murder. The difficult aspect of locating shoe impressions in forensic cases is that 96% of impressions aren’t used as sufficient forensic evidence (Moles & Sangha 2003). Only 250 pairs of these shoes had been sold in…

Dr. Edmond Locard’s Exchange Principle states, “Any action of an individual, and obviously the violent action constituting a crime, cannot occur without leaving a trace.” It is hard to say Locard’s Exchange Principle was not disregarded. After three months of expert investigation it was found that the DNA evidence that was discovered at the scene did not belong to Jennifer or Noura. Also Noura’s own DNA was not found at all at the scene of the crime. It is very hard to understand how Noura could have made extreme violent contact with her mother and not left any fingerprints, footprints, hair, skin cells, blood, bodily fluids, pieces of clothing or fibers behind. This lack of traces evidence sets off two different paths in my mind. One way leads you down a road of pure hatred for a parent. Everyone was felt this way one time or another in their life, where a disagreement or argument over something that is usually aimed at protecting the youth, leads to a massive outburst or feeling of rage, that is always immediately followed by guilt or remorse by a normal human being. But what happens when this rage affects a “not so normal” child. One with malice aforethought, that is just so tired of being controlled that they premeditate a murder and thoroughly clean any trace of evidence. The other path is the road Noura’s defense took. She is irrefutably innocent and Jennifer’s killer/killers are still on the loose.…
