Role and Functions of Law
Laws assist in many purposes in both business as well as society. The author will discuss the roles and functions of law in both business and society. This discussion will cover the different types of laws including statutes, common laws, treaties, ordinances, and executive orders. The author will also discuss the classification of those laws into criminal and civil law, substantive and procedural law, and public and private laws. There will also be a discussion about the different types of courts.
Functions of Law in Society
Law is a body of rules of action or conduct prescribed by controlling authority, and having legal binding force (Melvin, 2011). The laws within a society obtains direction through social behavior. These laws assists the society in operating more effectively and efficiently. There are separate laws that support ethical standards and expectations. The measure to assist with the enforcement of conflict resolutions and how to settle them are included in the rules and laws of conduct. Although the general functions of law appear to be rather simple, the United States legal system is actually very complex. Laws are broken down into several different types. These include constitutions, statutes, common law, administrative regulations and decisions, treaties, ordinances, and executive orders (Bushman, Feb).
In society, the role of law is to sustain moral order and discipline. All citizens are to obey the law, and violators will be punished. Laws permit society the ability to tell apart between state laws and federal laws. Laws are necessary to prevent people from fighting, and the ability to settle disputes without aggression and violence. Federal laws are superior to state laws, if a state law has a conflict with a federal law then the state law becomes ineffective. If a society does not have any laws, it becomes a society without control. Confidentiality builds a feeling of trust and inspires peace
