Reporting party stated that on 10/17/17, a door was closed on her daughter, Aaliyah Chavez (DOB: 02/10/16) , her right index finger. Staff told RP that the child was behind another parent who was picking up their child and staff did not see the child go behind the parent. On Monday February 29, the custodial staff at the Middle School Building at St. George’s Independent School called the police station to state that they had found a dead body lying face down in the office of room M223. There was no evident cause of death: no obvious trauma, no gunshot wounds, no puncture wounds, but blood was found on and around the body. There were cups of dr. pepper and a sticky note pad along with some other evidence found on the crime scene. Juliana has been attending school however, spends much of the school day in the office because she is unable to stay in the classroom for greater than 30 minutes. On 5/5/2017, I was called by Ms. Kathleen Seward, Principal at the West Somerville Neighborhood School. Ms. Seward reported she called the Crisis Team to come to the school as Juliana was "out of control" and had attempted to lock herself in a locker, and when approached assaulted a staff member. On April 21st, School Resource Officer of Great Oak High School, Israel Sosa, made a police report upon an allegation of suspect Brandon Trinh carrying a knife on school campus. Upon further investigation, Brandon admitted to carrying a pocket knife with a 3’’ blade for several months for the sole purpose of intimidation against the bullies in his JROTC class and had reportedly stated he “only showed one other student.”. Courts allowing substantive due process claims in connection with corporal punishment have found the threshold for recovery for the violation of a student’s rights to be high. Minor pain, embarrassment, and hurt feelings do not rise to this level; actions must literally be ‘shocking to the conscience.” Disciplinary actions that have not risen to this level include requiring a ten-year-old boy to clean out a stopped-up toilet with his bare hands, physically and abusively restraining a student with disabilities in multiple incidents, shoving a student’s head into a trash can; and shaking, screaming and spitting on football players. The purpose of this paper is assess the limits search and seizure in public schools, apply specific ruling, analyze the New Jersey v. T.L.O. case and explain, recommend changes to existing (specific) laws to create a fairer educational setting in terms of search and seizure and peer review. School officials are responsible for providing a safe and orderly school environment. The officials are required to address disrupting or unsafe behavior that violate school policy and rules. It may require searching of students and their belongings. Dealing with disrupted behavior is a difficult situation that requires decision-making on when, where and how to conduct a search and seizure. Washington Elementary School is located in West Orange, New Jersey in a neighborhood where mostly African American and Hispanic businesses and people were surrounding the area. As I arrived to the school or left, I usually only saw minorities in the surrounding neighborhood. This correlated with the students I saw in the classroom I observed, and throughout the school. In the classroom there was a total of 17 students, all of which were minorities. Ten of the students are Hispanic and seven are African American. I did not see too many White or Asian students throughout the school, or in the neighborhood. However, the racial and ethnic demographics for West Orange showed that the majority of the population is White. Statistics on race and ethnicity show that 62.1% of West Orange identify as being White, 17.1% as being Black, 10% as being Hispanic, 8.1% as being Asian, 2.4% as being two…
Josh attended Eastern High School during is Freshman, Sophomore, and Junior year. Josh is now a twelfth grade student at Whiteoak High School. Josh is very friendly, and respectful to his peers and teachers. Josh participates in class. Josh has been coming to class prepared and has been completing assignments on time.
