INTRODUCTION

The development department in Gmax Holdings Company is responsible for undertaking construction development projects management. The department is seeking responses from Maverick Subcontractors Limited to this Request for Tender (RFT) reference number XNH5678 for the construction of a large residential house.

COMPLIANCE WITH PROPOSED CONTRACT AND SPECIFICATION

Maverick should submit a tabulated statement showing, in order of the relevant clauses, its compliance level with the specifications provided. Above all it should also show full details of non-compliance if any (Stevenson & Young, 2013). Maverick should note that substantive variations from the requirements will not be viewed favourably, not unless it makes satisfactory demonstration on the necessity of the variation to the department.

ETHICAL PURCHASING SUPPLY

Maverick is required to complete an Ethical Employment Statement. This helps in providing that the state will not enter into a contract, where the policy applies with any Tenderer that cannot satisfy the employment standards. This is in meeting its obligations to its employees under applicable industrial instruments and legislation at the time the construction contract will be awarded and continue to meet such obligations in the term of the

A late tender will not be considered and the opportunity will be granted to another tenderer. However, a late tender may be considered if Maverick will clearly show that a system interruption or denial of access to the tender box caused the late lodgment of the documents. Additionally, it can be considered in the case that the tendering process will not be compromised.

EVALUATION OF THE TENDER

The department will evaluate the received tender against the evaluation criteria. On the other hand, Maverick 's tender will not be deemed unsuccessful until such a time when they are notified of that fact by the department. The evaluation criteria will be weighted to reflect the importance of project requirements

SUCCESSFUL TENDER

The approval of Maverick 's tender does not give rise to a contract (implied or express) with the department. Most of all, no legal relationship will exist between the department and Maverick for the execution of the building of the large residential house, until a binding contract is executed by them. The department may decide to go into pre-contractual negotiations with Maverick in its absolute discretion. Maverick is bound by its Tender (Statement of compliance to the Proposed Contract forming part of Maverick 's response) to enter into the contract on the basis of the tender without
