Regarding your request, I am compiling employment law compliance plan for a Mr. Bradley Stonefield. Mr. Stonefield is planning to open a limousine service in Austin, Texas. The limousine service employment goal is to employ 25 employees within the first year. This memo will examine employment laws as well as how these laws are applied. Depending on the outcome if an employee files for discrimination the employer could pay compensatory damages, punitive damages, back pay, and/or charged with a Class B misdemeanor.
Texas Payday Law According to the Texas Payday Law an employer shall pay wages to an employee at least twice a month, if wages are paid twice a month each pay period must have equal number of days. If the employer fails to designate paydays the paydays default to the 1st and 15th of each month. A child under the age of 14 cannot be employed except under specific circumstances. Children under the age of 18 years that are employed their employment will not interfere with their education, safety, health, or general well-being. An employer who violates the Texas Child Labor Law can be charged with either Class B or Class A misdemeanor (Texas Workforce Commission, 2014). Mr. Stonefield should employ those that have obtained a regular driver’s license. Teens under 18 may obtain a learner license and/or a provisional license.
Texas Minimum Wage Law Texas Minimum Wage Law states as of July 24, 2009 the federal minimum wage is $7.25 per hour. Employees are not prohibited from requesting a higher wage. Based on Mr. Stonefield owning a limousine company he may count tips towards the minimum wage. A violation of this law must be reported within 2 years of the unpaid wages.
