I am writing to you to address your recent executive orders in my local state the state of Arizona. First I would like to explain that the rights are always taken government tyrannical, and separate those that can be or are justified. If anyone calls though they have the 1st amendment right, that it is justifiable. But a person, who is giving out their opinion, even if it’s the contrary of you, should not lose their right to do that, it is all about understanding the intentions the founders had when they were writing the Bill of Rights.
Lately, your agents have come into my town of Nogales and forced citizen’s people out of their homes against their will, claiming for their own safety. Mr . Obama, if this is not a clear violation these peoples 4th amendment rights. Although their may have been flooding in some areas, even though the houses were not, it is still not justified in telling these citizens that they must leave their private residence. Even if that citizen was in some type of danger you still may not force them to leave their private home. It is their right to choose where to stay or leave even if they are in danger.
Another situation we have been having with your agents is that they will not legally owned firearms inside the of the storm shelters. This is also a violation of our constitutional rights. If the shelter were privately owned it would be different and I would agree that no arms would be allowed. But if it is a government run storm shelter being opened to the public of the city, then they should have the right to bring whatever property they would have with them. Sometimes a firearm is one of the only things that your are constantly being escorted for by policemen or body gaurds with several guns set up all around us and your family to protect you at public events, would you please consider telling your agents to step aside on the gun situation?
So all together I would just like to ask that you’ll do what is upright and correct and restore constitutional law to my town of Nogales. I would really appreciate you taking the time to read my consent Mr. President
Sincerely,
Pablo Najar

I am sending you the following correspondence in reference to the Department of Homeland Security and its structure. I wish to examine the arguments for the existence of this department and the concepts and information provided in my “Police Administration” textbook about the department. I ask you to consider the question “Is the feeling of heightened security worth the risk of eroding our individual Constitutional rights and freedoms?” In this memo, I will provide my opinions to you, the President of the United States of America, on how this Criminal Justice Agency is structured and whether or not it is effectively managed.…

I now reiterate these sentiments; and, in doing so, I only press upon the public attention the most conclusive evidence of which the case is susceptible, that the property, peace and security of no section are to be in any wise endangered by the now incoming administration. I add, too, that all the protection which, consistently with the Constitution and the laws, can be given, will be cheerfully given to all the States when lawfully demanded, for whatever cause—as cheerfully to one section as to another.…

During America's most consequential wars, the United States government has restricted civil liberties of the American people despite the nation’s strong rooted foundation for preserving every citizen’s rights. When danger is an ever present factor for the nation due to war or conflict restrictions are often placed on some of the most basic freedoms and liberties. Perfect balancing of these restrictions is vital to the countries wellbeing. One of the most well-known examples of this type of restraint is Abraham Lincoln’s precedent of suspending the writ of Habeas Corpus and issuing martial law. Lincoln’s actions clearly violated the rights of the people that are guaranteed to them under the Constitution. While out of context it wouldn’t make much sense, the specific circumstance’s Abraham Lincoln was facing completely justified his unconstitutional orders. In retrospect we can now see how important Lincoln’s decisions were; If not for his actions the union may never have won the Civil War and history would have been irreparably altered. History repeated itself when following in Lincoln’s footstep’s, President Franklin D. Roosevelt authorized the internment of over 100,000 people of Japanese descent in response to Japan’s attacks on the Pearl Harbor Naval Base. The country was in a state of panic and a response was needed to make Americans feel secure. Less than five decades later a similar attack devastated America. Similar to Roosevelt, George W. Bush was catapulted into taking responsive action after the September 11th terrorist attacks on U.S soil. His response was the Patriot Act. It was our founding fathers intentions for the people of these United States to be sheltered by liberty and freedom, however, it’s clear that later day presidents used a strong balance of discretion and justice for the sake of a greater good and national security. The government should be able to impede certain civil liberties should the situation arise where it is necessary as long as…

An American’s civil liberties are among some of the most important rights awarded to a citizen. After 9/11 some of those liberties were taken away by the expansion of executive power, the National Security Administration or NSA’s domestic surveillance program, and the use of “national security letters” to force information from citizens. Research conducted by Benjamin A. Kleinerman concludes that there are three criteria that must be met in order for a president to expand his executive power. First, it must be justified, or pass the “necessity test”, which means public good is insufficient grounds for discretionary power because “only political necessity and not popular or congressional approval can legitimate any discretionary action taken by a president.” This is to keep constitutional order in-tact (Rajaee). Second, Kleinerman states, “Discretionary action should only take place in extraordinary circumstances and should be understood as extraordinary.” A president should be able to justify their behavior in terms of their constitutional responsibility, which would require a restoration of “the notion of executive prerogative to the sphere of public discourse” (Rajaee). Third, “A line must separate the executive’s personal feeling and his official duty. He should take only those actions that fulfill his official duty and the preservation of the constitution, even…if the people want him to go further.” The Patriot Act for example, is a…

Recently my town has been under crises, the crises of a hurricane. During this time period, multiple problems have occurred that have been unconstitutional. The rights my fellow people as well as I have should not have been abused. I understand that the government must safeguard and limit our rights to protect the safety of its people, however I do not support the actions that have took place in my town. The government must balance the rights and needs of individuals with the needs of the public, but the rights that were taken away from my town’s people were not beneficiary to the needs of the public.…

The decision to bring the Ohio National Guard onto the Kent State University campus was directly related to decisions regarding American involvement in the Vietnam War. Richard Nixon was elected president of the United States in 1968 based in part on his promise to bring an end to the war in Vietnam. During the first year of Nixon's presidency, America's involvement in the war appeared to be winding down. In late April of 1970, however, the United States invaded Cambodia and widened the Vietnam War. This decision was announced on national television and radio on April 30, l970 by President Nixon, who stated that the invasion of Cambodia was designed to attack the headquarters of the Viet Cong, which had been using Cambodian territory as a sanctuary.Protests occurred the next day, Friday, May 1, across United States college campuses where anti-war sentiment ran high. At Kent State University, an anti-war rally was held at noon on the Commons, a large, grassy area in the middle of campus which had traditionally been the site for various types of rallies and demonstrations. Fiery speeches against the war and the Nixon administration were given, a copy of the Constitution was buried to symbolize the murder of the Constitution because Congress had never declared war, and another rally was called for noon on Monday, May 4.Friday evening in downtown Kent began peacefully with the usual socializing in the bars, but events quickly escalated into a violent confrontation between protestors and local police. The exact causes of the disturbance are still the subject of debate, but bonfires were built in the streets of downtown Kent, cars were stopped, police cars were hit with bottles, and some store windows were broken. The entire Kent police force was called to duty as well as officers from the county and surrounding communities. Kent Mayor Leroy Satrom declared a state of emergency, called Governor James…

The Constitution’s Structural Limits on Power Should Be the Focus of the Bill of Rights” contains many valuable insights. In particular, it re-affirms the proposition – lost for many years but perhaps gaining some new currency – that the so-called “structural” provisions of the Constitution are, and were intended to be, not merely matters of mundane and perhaps outdated institutional design but core protections of individual liberty. Further, it rightly emphasizes that the antifederalist-inspired Bill of Rights amendments work together with the Constitution’s structural provisions to limit government and promote individual liberty by reducing the federal government’s power even in areas in which it is granted authority.…
