In May of 1927, the Supreme Court stated that “a bootlegger would have to pay income tax on his illegal bootlegging business.” With this law coming into place, the IRS was created. The IRS was under control by Elmer Irey, who would make taking down Al Capone his top priority. Capone was carful in the fact that he paid for a majority of his possessions with cash, however, Elmer Irey was giving an opportunity to document Capone’s income when Capone bought a house (Palm Island estate) that he started to renovate in a very luxurious manor. Although Capone bought everything with cash, the one thing that Capone did not account for was the tangible assets of the Palm Island estate, which concluded that Capone had to have made a huge income in order to have an estate such as the Palm Island
