In chapter one of Law in America, the author Lawrence M. Friedman states that every country has a law and people must follow that law. Friedman gives an example of the newspapers, where the newspapers can only publish what the law says only. The police officers will only use their state law and each state has created its own individual state rule.
They must follow the law and follow the rules and be fair and equal to all people. Also, Friedman defines the rule of law as, “law is, above all, collective action: action through and by a government” (pg. 4). Additionally, slaves could not collect any salary for their work and could not quit their job without completing years of obligation or they would face death. Slaves couldn’t be a full citizen or be seen as a complete human. Slave women were sexually abused and frequently gave birth to white children; however, those children would still be slaves. So, Friedman is portraying that the colonial time’s slave owners sexually molested slaves’ and impregnated them. However, white people who lived in the South and had property, money, and slaves, also had political power and they did not free their slaves at all. Since slaves worked on their plantation, then without them whites could not consume their benefit. Those states had written into law that slaves were animals and they were not viewed as human. Furthermore, that rule says slaves were equivalent to cattle, therefore they are not human. Nowadays, people feel shame because of the laws that state’s slaves were equal to animals and the way black people were treated after slavery. Currently, people are knowledgeable and have more experience than colonial time, and also know their rights as humans. That shows that the American people disliked being controlled and obeying Britain’s rule; although, they still needed to have, “Government of laws and not of men”. Now they could practice equal rights of the people. Each state government wrote their own rule. Then all the state governments started coming together and making their first union. The script that resulted from this is the United States Constitution and the country exercises today. The United States has the oldest existing law in the world and their laws still stand today.
