On 04/17/2015, at approximately 0119 hours, I was on routine patrol in a marked police vehicle. I observed a red in color sedan travelling North on State Route 924 (Main Street). While the vehicle was in motion the operator failed to activate the headlights, driving without headlights during dusk. I proceeded to turn around, to travel in the same direction as the described vehicle. I activated the emergency lights stopping the vehicle at Main and Washington Streets.
I approached the driver and requested his license, registration and proof of insurance. Before the operator supplied the documents I requested he asked why he was being stopped. I informed him that it was because he was driving without his head lights on. While speaking with the male I noticed red glassy blood shot eyes, a slow slurred speech and an odor of an alcoholic beverage emitting from inside the vehicle. I question the operator how much he has been drinking tonight. He related he wasn't and just got off of work. I asked again and he stated "maybe two beers". The operator then supplied the documents I previously requested. At this time the operator was identified through his Pennsylvania driver's license as Richard W. At this time I requested the defendant to exit the vehicle and to submit to a series of psychophysical divided attention test, none of which he could successfully complete.
I requested the defendant to submit to a chemical test of blood at the Schuylkill Medical Center South hospital to which the defendant agreed to submit to.
I transported the defendant to the hospital where a blood sample was drawn from his right arm. The defendant's arm was wiped clean with a sterile non-alcoholic prep pad prior to venipuncture.
The toxicology report indicated positive findings of: 0.181% (Percentage WT/VOL
w/v).
