Understanding this, it should be understood that it should not matter what individuals believe, who they donate to or what or who they support. However, it appears more and more often that this idea of 14th amendment is being used to limit the 1st amendment. In another recent Pew Research study, they found that 40% of millennials would be in favor of limiting what people can and cannot say. Especially in regards to or about minority groups. This was compared to other groups such as Gen X and Baby Boomers where the percentage was found to at 27% and 24% . This stark compression shows what some are willing to give up, in order to appease others and to prevent the sins of the past.…
Article 1 of the constitution covers the purpose and the organization of the House of Representatives and the Senate. Though there are ten sections in the Article and numerous subparagraphs, this paper will focus on the structure, and a few of the subparagraphs concerning its function. We will begin with the organization since this should be covered before the responsibilities are addressed; this starts in the second section, with how the house will be selected, the requirements to be selected, and how the proportions should be arranged. This was an extremely sensitive subject for many of the delegates at the time of the framing of the constitution due to representation.…
Due process is a concept that dates back all the way to the early 13th century, when the Magna Carta was signed by King John. Due process of law is the principle that a person cannot be deprived of their right to life, liberty, and property without appropriate legal procedures and safeguards. It is first found in our constitution in the 5th amendment, and then it is once again stated in the 14th amendment. Due process is the only principle that is repeated in the constitution. (The Constitution states only one command twice.) There is little difference between what is said in the 5th and 14th amendment, but the one word that was added has had a monumental impact on our nation. The addition of the word “state” in the 14th amendment means that…
The Era is an amendment that is connected to the 1848 women’s suffrage movement in which they were trying to fight for equal rights. The Era is meant it help them achieve their dream of gender equality by specifically stating in the constitution that all women have equal rights under the U.S constitution. In relation to the 14th amendment the Era addresses the issue of equality but unlike the 14th amendment it specifically addresses the inequality between both genders. I am in favor of the Era because it will guarantee equality to women and protect them under the laws of the U.S constitution. If the Era passes it will resolve issues such as equal pay, providing a clear judicial standard for deciding cases on sex discrimination, and it will prevent congress from weakening or replacing existing laws on women’s rights.…
In order to understand the cases that brought about the drastic change in the interpretation of the 14th Amendment, the three clauses of the 14th Amendment must be understood. These clauses help define what it means to be a U.S. citizen. The privileges or immunities clause was first written in Article IV section two. It was then written again in the 14th Amendment after slavery was abolished in order for equal protection guarantee. The federal government wanted to insure that states respected the rights and freedoms of former slaves. In the first section of the 14th Amendment it states, “no state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United states.” This clause was written so that…
The 14th amendment is very important to America and it's people. Without the 14th amendment a lot of us would be treated very differently. How are you supposed to defend yourself when your not even considered equal to the same people just like you? That is exactly why the 14th amendment was created, to give the people a way to be able to everyone else. I completely believe in the 14th amendment and the reasons behind it. Think about if we didn't have it, so many things would be able to happen that we might not be able to prevent because we aren't equal to everyone else.…
First, I wanted to start by stating that not only was your post compelling, but it was also well researched. Secondly, I agree with you that the idea of amending the 14th amendment, to exclude children born in the United States (U.S.), by undocumented immigrants would be absolutely horrific. In addition, I also agree with your statement that children born in the United States, whose parents are illegal immigrants should not be punished just because their parents are not U.S. citizens. It is tragic that so many people are blinded by the stereotypes of illegal immigrants that some U.S. citation will speak ill of infants born by undocumented immigrants. A survey was taken in 2011 which showed only 57% of American citizens wanted to keep the…
In 1868, the 14th Amendment was ratified into the Constitution, and has since become a key component in the construction of democracy in the United States. The amendment is broken down into five independent sections of impartial notions that forbids states from rejecting the civil rights and liberties, and to accord fair chance of life, property, and due process regardless of race. The 14th Amendment outlined civil liberties and rights while limiting state's intervention, therefore making it an important aspect in American democracy.…
For more than two hundred years the bill of rights also known as the first ten amendments of the U.S. constitution has been responsible for protecting the American people and maintains their rights and freedoms. One Particular Amendment in the United States constitution of importance in the legal system and unparalleled is the 4th Amendment. Since the 9/11 attacks Muslim men have been persecuted by what they wear and believe because of America’s fear on another attack on the United States.…
The 14th Amendment was adopted on July 9, 1868, which addresses citizenship rights and equal protection of the laws. The 14th Amendment formed the bases for landmark decisions such as Brown v. Board of Education in 1954, which was regards to racial segregation. Roe v. Wade in 1973, in regards to abortion, and the most recent of 2015 was Obergefell v. Hodges, in regards to same sex marriage. The 14th Amendment to the U.S. Constitution contains four sections. The first section guarantees citizenship to any and all persons born or naturalized in U.S. Also, it guarantees all Americans their constitutional rights and denies states the right to limit through legislation where they are.…
From the start of the year 1865, our country had a way to prove every citizen rights, As a ratified document in 1868 the 14th amendment was a huge support for Lincoln's original goal. No State shall make or enforce any law which shall abridge the privileges or immunities of the United states; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny any person within its jurisdiction the equal protection of the laws.” Lincoln's ideals are brought out through this document, although he’ll never know of such an powerful document, his goal is partially completed. Not only that it held a powerful message of equality and rights, but through the text a message of hope is being shown. Therefore, if the 14th amendment can support his goal and have a message of hope, then he can show our country is changing and will be greater as a whole in the…
A provision on equal protection in the Fourteenth Amendment of the Constitution looks towards protecting the civil rights of people living in the United States and has been used in defining the right of individuals and groups living in the country. In analyzing the provision of equal protection in the 14th amendment, the courts consider three aspects. First is the type of classification that a particular group falls through, for example, suspect classification or any other classification that the court can create and interpret. After determining the classification, the courts will determine the level of scrutiny applied to the identified class, whether it is a strict scrutiny or an intermediate scrutiny. Lastly is the determination of the kind of action that…
I enjoy reading your post. I would say that one of the reasons the 4th Amendment is so important is that it is reflective of the Colonists' own experiences. The Colonists were outraged on many levels that British soldiers could enter their homes, seize their belongings, or search their property without any probable cause or authentic paperwork. The fact that warrant-less and groundless searches became so prevalent is one reason why the 4th Amendment strictly states that justification and authentication must accompany all searches and investigation of property and belongings. Another I would say that the 4th Amendment is important is that it represents a fundamental right of a person accused of wrongdoing in a legal sense. The 4th Amendment…
Lastly there is the 14th amendment makes it so that all people regardless of race, gender, etc. have the right to life liberty and property which can’t be denied by the…
Over the past centuries, there have been debates on how to define the “real” American and the “real” American identity. A lot of these struggles also led to Civil War (1861-1865). After war, congress passed the 14th Amendment to answer the question of whether former slaves could be citizens of the United States. The Amendment says that all persons born and naturalized in the United States are citizens of the United States. But debates on who is a “real” American, who could stay in the country and who should get kicked out continued.…
