Many of the issues that were involved in resolving legal disputes in international transactions are the differences in customs and laws that regulate contracts for the sales of goods internationally.
2. What are some practical considerations of taking legal action against a foreign business partner based in another country?
In an international business, some of the practical considerations of taking legal action against a foreign business partner based in another country are arbitration through a binding or non-binding contract, as well as, U.S. Court litigation, or the countries legal system from the foreign business partner.
3. What factors could work against CadMex’s decision to grant sublicensing agreements?
Some of the factors that could work against CadMex's decision to grant sublicensing agreements are the time and cost involved, and ensuring quality standards of drugs produced by sublicensing. In addition, the Candorian government may not want to do sublicensing because a generic drug is more affordable for the population.
4. When the local customs and laws conflict with the customs and laws of an organization operating abroad, which should prevail? Explain why.
When local customs and laws are conflicting with the customs and laws of an organization operating abroad, the customs and laws of that organization should prevail because such laws are set as a standard for the benefit of the company. For example, health laws cannot be changed due to concerning health issues, but on the other hand reasonable accommodations can be made for religious purposes.
