On September 27, 2007 the actor George Clooney from films Ocean 11, Burn after reading, and Men who stare at Goats was taken to a New Jersey Hospital. He was taken along with his girlfriend Sarah Larson as the result of a motorcycle accident.
On October 10th 2007 after an internal hospital investigation it was decided. Twenty seven hospital employees would be suspended for a month without pay for privacy violations. The employees had given information to the media regarding …show more content…
Mr. Clooney’s medical condition. Mr. Clooney who is used to personal invasions of his privacy was not concerned. He even asked the hospital to not have the employees punished.
What did these employees do that was so wrong? After all he is George Clooney the movie star. Why did the hospital wish to see their staff punished if George Clooney did not? What reasons did they have for suspending 27 staff for a month? Hospital spokeswoman Eurice Rojas said “accessing a person’s medical records without permission is a violation of the Health Insurance Portability and Accountability Act a federal law that protects the privacy of patients.
As it turns out the hospital was required to address the breach of Mr. Clooney’s privacy. It is not agreed upon that the punishment was not severe enough. The hospitals spokesmen stated that “its physicians and employees, adheres to a strong code of ethics that respect the privacy and confidentiality of all of our patients”. It is continued “our commitment is to always conduct our behavior in the highest possible standards and any conduct that violates the trust of our patients and high standards we set is taken very seriously and treated in a very serious manner.”

Confidentiality is the right of an individual to have personal, identifiable medical information kept private.
Such information should be available only to the physician of record and other health care and insurance personnel as necessary. Privacy is an individual’s constitutional right to be left alone, to be free from unwarranted publicity, and to conduct his or her life without its being made public. The name of the government agency in charge of making the rules and standards regarding the protection of a patient’s health information is the Health Insurance Portability and Accountability Act or HIPPA as it is more commonly known. Before HIPAA there really were no safeguards except the oath of Doctor patient confidentiality. This left patients who felt violated against to seek legal action. These legal actions shattered confidence between Doctors and patients. This also wasted time and money with court costs. The Health Insurance Portability and Accountability Act (HIPAA) of 1996 require all professionals and organizations to guard the privacy of their patients and customers. practice. What health information is protected? All individually identifiable health information is covered. All information recorded either electronically or on paper. All information that is stored or held by a health organization is protected. If information is transmitted from one health organization to another it is protected. How can you protect a patient’s health records? We have passwords on computers, training of employees to not discuss patients, and only release information after receiving a signed consents but it that enough? Obviously that is not enough since we are all taking a class to learn how to properly safe guard patients records. This is a very complex problem. There are in some cases delays in proper medical care due to HIPPA. There are instances where a Doctor needs access to medical records quickly. Having HIPPA has fused the Medical and Information Technologies fields together.
When patient records were recorded only on paper it was much easier to identify and protect records. However, with records now stored and accessed electronically health care protection of records have to change. Along with HIPPA health organizations also have to be licensed. Licensure is the process that gives a facility the legal approval to operate. Each state set up its own rules and oversees the licensure of its health care facilities. In order for a healthcare organization to participate in the Federal Medicare and Medicaid programs. These organizations must also be certified. In order to become certified the health care organization must be reviewed and meet minimum
standards. Accreditation is an external review process that a health organization requests to go through. There are a number of agencies that will review the organization for accreditation. Even though a health care organization does not have to participate in accreditation there are reasons for them to request it. Some of those reasons are increased payment reimbursement, lowers insurance premiums, and give the organization a competitive edge. In addition to the licensure, certification, and accreditation there are also state and federal laws and regulations governing privacy and confidentiality.

The administrative information includes financial data and is used to support managing functions and general operations for health care organizations. Clinical applications are used by providers to diagnose, treat and manage patients care.
